Is absolutely untrue that Mrs.Mowvre was a contributor to Town Topics.Col.Mann sent to ber and wrote to her for autographs of various prominent society people for Fads and Fancies, but she refused to give them; her husband refused to become a subscriber to lads and Fancles and summarily dismissed the visitor thut called on him.\u201d Robert J.Collier, manager and publisher of Collier's Weekly, was the first witness.To Mr.Shepard, vf counsel for the defence, he said: \u201cIn October, 1804, à vopy of Town Toplcs was delivered at my house, and | saw in it an article referring to Miss Alice Roosevelt, only by her first name.When 1 went down to the office 1 called Hapgood's attention to that article and told him I thought it was the vilest article ever printed in any newspaper and suggested that he write something about it.He did sn.an editorial, headed, \u2018The most degraded paper in the United States.\u2019 Hapgood, in his article, however, did not name the paper, but when I read the proof I wrote in the name Town Topics, telling Hapgood at the same time that my action would doubtless involve us in personal abuse.\u201d After the arrest of Charles Ahle, the solicitor.Mr.(\u2018olller sald, Hapgood wrote annther editorial, and while he was doing so Mr.Collier told him to say in it that it was a disgrace for any judge to be connected with Town Topica.Under cross-examination by District Attorney Jerome, Mr.Collier said that before the article about Miss Roose- volt appeared in Town Topics, a series uf articles containing unpleasant things nbout the witness was published in Town Topics.Mr.Collier said he was indifferent to what Town Topics said about him.The meaning of the editorial on which the complaint of libel wax based, he said, was that Town Topics was cngaged in the business of blackmail.Fads and Fanries, he said.brought that aspect vf the publication more forcibly to his mind.Mr| Jerome asked Mr.Collier if he knew that President Roosevelt and Grover Clevaland were to be subscribers to and have their names in Pads and Fancies, to which he replied tha he did not know it.Norman Hapgood was then called the stand.\u201cI believe you are the defendant.although ! ain not certain.\u201d sald Mr.Shepard.Mr.Hapgood admitted it.He described the cureum- stances attending the writing of the editorial on which Hbel action was based,
