and three stations were chosen at one mile oft’ Greon Island, in the centre, and three miles from Red Clif. The usual depth ls 50 to 40- fathoms: but the water is much deepernear the north shore. The bottom appears to be bare rock running in ridges llel with the direction of the strait. The steamer was anchored at these stations for one or two days at a time; and was moved from one to another to ascertain any difference in the current av the two sides of the straits while the same conditions of wind and weather prevailed. The tides were obse simultaneously at Foiteau” Bay, within 12 miles of there stations.“The current on the north side of the strait ran inwards from the east for a longer time thap on the south side; and outwards from the west for a shorter time.Aixo, on the north aide, the current from the cast as shown by the path of the iveberz, was stronger ‘than the current from the west, while on the south side the currents were tical- prac y equal in the two directions. Also, uring a period persistent current from the east ervations at the last named statiofi, at the north side, compared with the speed of icebergs near the south shore, showed that the current was practically equal at the two sides of the strait. From there observations, and also from a comparison of the current as measured successively at the different stations, it appears that there is on the whole a vendency on the south side to greater tidal regular ity, and on the north side to greater persis- tency of flow in oné dircotion or the other. This is probably due to the greater depth on the north aide, and consequently the greater monientum of the water there, as compared with the frictional resistance.” ; that the oar had been fully lighted; that Brazeau's horses had onl »n seen coming when at a distance of fifty feet and that the motor man had then every available means to stop the car., The proof had established that the track had been in bad condition, the rails project ing over the level of the street, thereby ren- - dering it extremely difficult for an agKon or carriage whi to thereon to extricate therefrom, and thst complaints had previously been made to the Company ' concerning the condition of the track. The cri Sr A SPE LOB dn TI JR — x repas me apt i Ÿ * car had been moving at the time at an im- : nioderate rate of speed, this also had been the subject of complaint on the part = of the inhabitants of the locality, to the : Company, prior to theaceident. The fact of + the motorman having been unable to stop the car until it had some feet beyond where the accident had occurred, would have to be accepted as evidence elther of a defective system of brakage or of incompetency on the part of the motorman. While it kad Djestablished that Brazeau, for some hours before the collision, had been A ea ; rather freely of ; intoxicating RE Qo! t did not satis orily appear tha iN he had boen at the time so intoxicated as to 18 render him unahle to guide and control his A horses, and it bad Leen proved that he had Cos at the time been endeavoring to extricate his n from the track. The primary and principal cause of the accident had been.due to the negligence of the Company.Jugment as above.i At the Empire Theatre, Newonsile, an amusing episode recently oocurred.Mr.Walter Kino, the favorite comedian, had a diamond ring presented to him by his friends, but the strange part Of it was that it was inclosed in the heart of & sma!l cabbage thrown on the stage.; but the screens had tinpeded the work of the firemen.r.Pierre Lacroix, building inspector.was next called. He did not consider that outside fire escape ladders would have been any better than the exits provided in the factory. In answer to Mr.Lafontaine, Mr.Lacroix said that there would be considerable dan- r ot Joss of life in case of fire ut the City all, In answer to Mr.Mitchell, said he DID NOT KNOW ANY BUILDING In Montreal better provided with means of escape in case of fire then Mr.MoDonald's factory.Mr.Mitchell, factory inspector.stated that he bad frequently visited the Me- Donald factory. He had never required that fire escape ladders should be provided, as he had considered that the arrangements were as perfect as possible. The law allowed the factory inspecturs to exercise a great deal of discretion.- Mr.Guyon, Factory Inspector, gave some evidence similar to Mr.Mitchell's.hilias Viau, fireman: Jos.Charpentier, cohstable, and Nap.Burel, fireman, were next examined, after which Patrick J.Sexton was recalled. He was followed by Mr.T.Howard Stewart, assistant superintendant of the factory, who corroborated the evidence of a number of preceding witnesses, Messrs.Charles Payne, William Fleeson and Wm.John Findley were the last witnesses examined, and the coroner thea proceeded to sum up the evidence. The jury retired at half-past tive, and, after an hours deliberation, returned the following verdict. That Alphonsine Thibaudeau dived at Montreal on the 26th April, 1893, having thrown herself out of a window at the McDonald factory at the time of the firo, which occurred on the 25th April last, because she was prevented going downstairs b: John Maclean and Victor Lahsie, who acte: without malice, but in error of judgment. We believe it to be our duty to excuse them.We find cause to blame Mr.McDonald for not having had a staff trained to work the fire apparatus and to keep it in good order.Wo also find cause to blame the fnspectors for not having forced the owner of the factory to ailix fire esca on the Mr.Lacroix outside of the building. We arc likewise of), opinion that clause 19 of the regulations cohcern- Ing industrial establishments in the Province of Quebec should be amended.Ib was represented by Mr.Macmaster that the factory inspectors had done ail that the law required them. They had not been obliged to see that the men were trained in the use of the apparatus. The coroner ex- .-plained this to the jury, who conscuted to alter their verdict accordingly.CITY ITEMS.Judge Desnoyers will give judgment in the case of Emmanuel St.Louis on Monday next. The newly appointed chief of the Inland Revenue Department, Mr.D.Legault, will be sworn in to-morrow.A funeral service was sung at the Longue Point Asylum yesterday, in memory of the late Abbé Leclerc, chaplain.A Whter colur sketching class is being held daily during the month of May at the rooms of the Art Association, Phillips square.Mr.J.Ritchie Bell will conduct a song service, on Saturday evening next, in the musical parlor of the Young Men's Christian Association, Dominion square, A sailor named William Doran, had his foot badly crushed on the S.S.State o[ lieor- ia which is anchored at Windmill Point.© was taken the General Hospital for treatment.Rev.Canon Bruchesi, general chaplain of the French Canadian Artizans Society, is to deliver the annual sermon before the Quebec branch of the Society at their annual celebration next Sunday. The last meeting of the season of the St.Jude's Church Band of Hope will take place this evening in the lecture hall of the church.Mrs.Jarley's wax works is a prominent item in an interesting programme. The first of the season's concerts of the Catholic Sailors’ Club was held last evening. The programme was highly enjoyed by a large nuinber of seamen and citizens, The evening's entertainment included songs, recitations and instrumental music rendered by Mr.Parizeau, Dr.Wheeler, Mr.George Hofland, Mr.O'Callazan, Miss Law- lon, Miss Clark and Miss Wheeler.THE QUEEN'S BENCH.The following cases have been placed on the docket for trial at the June term of the Court.of Queen's Bench: The Queen vs.David Edward, murder: Queen vs.Victor Anderson, forgery: Queen vs.Frank Stevens, rape; but I can, with con- tidence, leave ‘‘Fairplay” to the pulverizing arguments of r.Ames, object is to bring under your notice the practical question of cost and production of carburetted water gas, which is, in my opinion, one of the moat important features in the question, and about which these gentlemen are evidently unly imperfectly informed.1.Water gas is a compound of hydrogen ussion the and carbonicoxide, in itself it has noillumi- nating value, but in the process of its manufacture, it is mxted, with hydrocarbon vapor, obtained by the introduction of petroleum or other oils, and is rat to à high quality, preferably to 24 to 30 candlepower: 2.Some incidental advantages attending the possession of a water gas plant are : It is most serviceable in case of & sudden increase of demand because of fog, cold weather, or from auy other cause, The apparatus can be put into full work at about four hours notice, while it takes as many days to bring into use an additional Leuch of returts.Often an extreme demand arises, which lasts only for a very few days.In such cases retorts are often lighted up at considerable cost and drop again without Leing used. This involves considerable cost and deterioration of the retorts, to no purpose.À water gas plant would be put to work, meet at once the need of the day and Le put out of action without any appreciable injury. As an “emergency” plant, therefore, it is of great value.- 4.The men employed for water against coal gas are in the relation of one to six, They need not be specially strong and trained men—intelligent youths can do all that is required after a few days training.4.The quality of the gas can varied at will.If occasion require by simply altering.the supply of ail a make of 0 candle gas can Le raised to 40 candles in a few minutes, The fuel used is gas coke.Coals yielding better coke though inferior gas can be employed for the bulk of the manufacture as may be found most economical.5.The large percentage of carbonic oxide in the gas is felt by many scientists to be an objection to it, this gas being wore quickly poisonous than is ordinary coal gns.On this ground the State of Massachusetts for some time declined to allow of its being supplied exclusively to any town inthe State. After wider experience tHe prohibition has been withdrawn and all over the State there are à vast number of towns supplied with water gas only. The quality of the gas is thoroughly permanent, and the flame is much whiter and clearer than coal gas of the same quality.Because, I believe, of the more rapid combustion of the carbon particles in the flame there is little tendency to smoke, even with very high quality. The cose of manufacturing 1000 cubic feet of 25 candle power gas, with a plant to produce 1,000,000 a day.would be as follows, PUEL.For generator 32 lbs.of gas coke at 8c per bush.eaten iiititaeriieeeaneaeeiaeaenteann 064 STEAM BOILER.81bs.of gas coke at Sc perbush.01.6 O1L.4 imp.gals.at dc per gal.….….….….….…….….16 LABOR.5 men continuously 24 hours.10men.02 Purification, time and Supcerintendency.Repairs and maintenance.29.0 Practical experience has now been fully obtained as to the many advantages of this pas in Great Britain, and I may cite Bel- ast, where the corporation laid down their first plant in 1892, with the result that they duplicated it last year, and that the gas costs them to make Z7 cents per 1000 cubic feet. The Beeton Works which are the largest in London, have now increased their water as plant Lo cight times ils original capacity. The Liverpool Corporation, after sending its engineer to the States in 1892, toexamine the different works in operation, have now laid down a plant to supply their city, and erected their own storage tanks for 10,000 tons of petroleum. My own firm has now in hand two municipal contracts for the supply of carburetted water gas plants and oil tanks to store 3000 tons of petroleum.stly, the Montreal Gas Company laid down a plant in 1882 for producing this gas, and have done so, much to the improvement of ita illuminating power, although in their contract with the city there appears the following clause 1: “The Montreal Gas Company do hereb; bind and oblige themselves to supply an furnish, during the space of ten years, to be computed from the first day of May, one thousand eight hundred and eighty-five, all the gas consumers within the limits of the said city of Montreal, with gas which shall be coal gas, manufactured solely from bituminous coal.” .One word as to capitalization. Our accepted authority on gas in Great Britain Newbigging, in his book, rays the eapi should not exceed £1 or $5 per head for a city such as Montreal. This would repre- rent $1,100,000 on à population of 220,000, and allowing for duties and extra protection inst frost the capital should not be more than $1.500,000.I trust you may consider theae few facts of sufficient interest to be published, in view of my proposal to the city, that the works we would supply tothem should produce half water gas and half coal gaa, I remain, dear sir.Yours faithfully, .8 Kivxe.THAT MONTH'S ADJOURNMENT.La Minerve does not put any faith in the rumor circélated in Winni that the ad- jourament of the Manitohe Legislature for a month was due to the officious interference of the Governor General In the hope that in the meantime, a compromise would be brought about.TAKEN EN DELIBERE, The case of James O'Brien.jr., accused of obtaining $20,000 from the Quebec Bank on false pretences han been en delibere Judge Desnoyers, judgment will be given lu a few days, FOR THE BENEFIT OF THE POOR.One of the mast interesting lectures of the season was that delivered last evening ln the Windsor Hall by Rev.Father McCallum on ‘“My Trip Abroad.” The object of the Sm as ‘work on exhibition.lecture was to raise funds to meet certain small debts which had been contracted by the reverend lecturer, who is the almoner of the poor in St.Patrick's parish during the winter, in the course of which he has had more calls made upon him than has been the case for seven years past. The trip wbich Father McCallum described to his audience was the one made when, as a theological student, he in 1868 left America to spend two years at the head seminary of the Sulpicians in Paris, and was enabled to be in Rome during the time of tbe last full Council of the Bishops of the entire Catholic Church, when in 1870 the doctrine of the infallibility of the Pope was formulated and became a dogma of the Church. The last portion of the lecture was devoted to experiences during the time of the siege, some of which were very thrilling.Of the delivery of the lecture, the racy stories and incidents interwoven with valuable information, it is needless to speak; Father McCallum is too well known as a model for lecturers, but a wore must be said in praise of the excellent stereopticon views, and also of some excellent singing by a choir of young men, under the direction of Prof.Fowler, which was highly appreciated by the large audience.MACNAB WAS BUCHANAN.The Condemned Doctor's Two Brothers ; also, after the passengers had retired and the cabin lamp was turned low, bed come on deck in his tall hat and pea coat, -| and smoke one Manilla cheroot, marching up and clown abreast of the wheel. You might tell the time by the skipper's star of tobacco aft, and strike the béll when he threw the stump away.He was marching up and down now at this hour of hard upon six bells; at the forward extremity of the short white lehgth of poop deck stepped Mr.Poole, the second mate; a solitary figure grasped the wheel, The sails swelled to the main royal, and from under the hows came a noise like water in little streams merrily running over shingle, ’ “Mr.Poole,” suddenly called out the Captain, in a voice that sounded harsh and artot-like, perhaps with the suddenness of t, and the soft silence it broke into.- Sir,” answered the second mate, and he | came swift aft, touching his hat as he met the old ski quarter-boat, clear of the wheel.“ Whose volces are those down on thie quarter-deck I" “One's Mr.Davenire, sir.1 think I bear Mr.Hankey, and there are two or three others.” “ Why don’t they go to bed?” “I don’t know, sir.” “ What are they doing, sir?” “Smoking, sir. After a short, expressive pause, old Benson said, “The mate tells me you knew Mr.Hankey before he came on board this ship.” “He cams out in a ship that I was in, sir.” * Who is het” the second mate speaking nervously, as a roung officer well might when challen y a skipped in the manner which old Benson Was NOW Wearing.‘*Didn‘t he come on board the ship the night before we sailed at your invitation?” “No, sir.A small boat sculled alongside.1 looked over the rail and was hailed by name.Recollecting the gentleman, and understanding that he was to be a pas senger a this ship, I asked him board.” a .“ What was your talk about?” — ‘ Many things, sir—I forget ; Now it was that old Benson, after taking A view of the compass, aud sending à searching look aloft and to windward, and after grufily delivering a sentence or two of instructions to Mr.Poole, went below to get some rest; but no man could tell at what hour this old skipper would re-appear, for he was mysterious as a spectre in this tricks of emergence.Often it happened that within ten minutes of the old dog's having gone below for the night, the mats of the watch, loungin at the rail, relieved of the tyranny of that bow-le presence, would look aft and start on beholding, walking close benide the wheel, the shadowy but familiar figure in a tall hat and long coat.Midnight was struck on the bell, a hoarse voice bawled down through the fore-seuttle, “Eight bells below there.D'ye hear the news?” The wheel was relieved, and the chief officer, with his eyes full of sleep, came up the weather poop-steps, and talked for a few minutes to .Poole, who then went to his cabin.’ moon was far astern on the quarter, sinking, and the burning light of the whaler gone long si Clouds of fleece flew across the stars, which rhook in splendour, and the barque .strained as she drove the brine into récoil- ing ashes. But the breess had header, they had braced pp in that first watch, and the ship was off her course.Scarcely twenty minutes had elapsed since the watch was relieved, when Mr.Matthews, who soberly paced the weather side of the poop: was surprised by observing © second ma iding with great rapidity across the deck from the lee ladder.Matthews came to a stand.le, exclaimed, breathing fast : * What do you think? The arma-chest in | my cabin bas been forced, and the whole of the weapons stolen |” CBAPTER VIL Vl THE CAPTAIN'S STATEMENT.- The barque hesled to a damp gust of the t reese as the second mate in a voice, his Fr nigh low wi tation, ke; : From the Richibucto, N.B., Review. There are few very people, especially among the agriculturists of Kent Co., .B., who do not know Mr.H.H.Warman, the popular agent for agricultural machinery of Molus River.A Review representative was in conversation with Mr.Warman recently, when the subject of Dr.Williams’ Pink Pills was incidentally touched upon.T.Warman said he was a staonch believer in their curative properties, and to Justify hilu opinion ho related the cure of his sister, Lisa, Jessie Warman, aged 15, who he said been “‘alinost wrested from the grave by Dr.Williams’ Pink Pills.” Miss Warman had beerd suffering for nearly a year with troubles incident to girlhood. She suffered from severe and almost constant headaches, dizziness, heart palpitation, and was pale and bloodless, and eventually became so wi and emaciated *hat her nts‘ thought that she was in cousumption, and had all but given up hope of her recovery. Her father, Mr.Richard Warman, who is a well-to-do farmer, spared no expense to procure relief for the poor suffercr. The best available medical relief was employed, but no relief came, and although the parents.were almost in despair, they still strove to find the means of restoring their loved one to health.Mr.Warman, like everybody else who reads the newspapers, of the many marvellous cures effected by the use of Lr.Williams’ Pink Pills, but like some others, looked upon these stories as “mere patent medicine advertisements.” However, as everything else had failed he determined that Pink Pills should be given 1, with result no less marvellous than that of many other cases related through the press.Williams’ Pink Fills have completely cured the young lady, so that in a few months, from a helpless and a aup- posedly dying girl, she has become a pictura of health and activity. The Warman family is so well known in this part of the country that no one would think of disputing any statement made by any of its members.Mr.H.H.Warman, on account of his business as salesman for agricultural machinery, is rsonally acquainted with nearly every- Pedy in the county, and we feel assured that any enquiries made of him concerning the statements made above will be readily answered. The gratifying results following the use of Dr, Williams’ Pink Pills, in the case of Miss ‘Warman, prove that they are unequalled as a blood builder and nerve tonic. In the case of young girls who are pale or sallow, listless, trou tation of the heart, weak and easily- tired no time should be lost in taking à course 0 Dr.Williams" Pink Pills, which will speedily enrich the blood, and bring a rosy glow of heaith to the cheeks. They are a specific for troubles peculiar to females such as suppressions, irregularities, and all forms of weakness.In.men they effect a radical cure in all cases arising from mental worry, overwork, or excesses of whatever nature.Dn Williams Pink Pills are manufactured by the Dr.Williams’ Medicine Co., Brockville, Ont., and Schenectady, N.Y., and are sold in boxes (never in loose form by the dqzen or hundred) at 50 cents a box, or six boxes for $2.50, and may be hod of all druggists or direct by mail from Dr.Williams’ Medicine Company at either address. He who cannot forgive others, breaks the bridke over which he must pass himself; THE COMPANY'S VERSION.Mr.S.Macanlay, the Company's manager, makes the following statement: “The ate Mr.Perreault, applied for a policy with us in August 1584 aud was accepted subject” to a very heavy extrt premidin. He never gave any note for this premium but on the other hand signed an agreement to pay the amount subject to the following proviso here set forth in full: .“It fs distinctly understood that this agreement is not to be considerod as na payment of tho anid premium, but mercly as an extension of time during which the said payment may be made; and if said amount be not fully paid at the expiry of anid extension, then the Joier shall; by that very fact, be null and void, without any grace, and without any notice whatever, and incapable of being revived except by the written consent vf the Head Office; and no payment can be made after the expiry of said extension excopt during the life and good health of the party assured; and the Company shall at all times have the right to refuse to.accept such overduo payment unless matisfled of the wood healih of the assured “af the ‘actual time of such payment: and this right shall not be considered to have been waived by any demand or act of any kind on their behalf, and cannot be waived except by an express formal written agreement to that cifeet, signed by either tho president ur secretary of the Company.Nevertheless, in consideration of the extension granted, the proportion of the year's premium correapoil- ing Lo said extension must be paid, together with an additional fifteen dollars for expenses incurred by the Company (the whole to not exceed tho amiount mentioned above), and the same shall bo legally recoverable, for value received.” Mr.Perreault never paid any amount whatever in this agreement and called in at the office and in the most positive manner refused to pay anything. He claimed that the agent had promised that tiie company would give him printing for the amount of the premium but the compan from the first refused to make any Ruch bargain and no such bargain was ever made. The premium was to have been aid in cash within the delay allowed ut as nothing was ever paid the insurance of course fell through. The company was tendered an unaccepted cheque at about the very hour that Mr.Perrault was dying and naturally declined to receive it, as they had tull right to in accordance with the agreement signed by Mr.Perrault.himself.If the money has since heen deposited tothe credit of the Company in the Banque du Peuple, it is something of which the head office of the Company knows nuthing. The Company thought it best to return this agreement to Mr.Per- rault's representatives in order to prevent any possible complications, but in reality it was entirely unnecessary for them to do so, and their position is not affected by this action.” Besidks the two policies in the Sun Life the other insurance on Mr.Perrault's life included 81000 in the Confederation, $1000 in the Etna, $5000 in the Mutual Reserve l‘und, or a totai in all of $10.500.Out of tbe above amount Mr.Perrault had transferred $7000 to the Masson estate as collateral for a loan of $32,000 together with a mortgage on the Perrault building.STOLE REGISTERED LETTERS.A young man named A.Dorion, employed in the Montreal Post Office as n clerk, was arrested to-day for stealing registered letters. When confronted with the proofs of his crime, he admitted hia guilt and produced the money. For some time past letters have been disappearing in a myster- fous manner.Decoy letters were sent through the.mails this morning, with the result that the culprit was arrested by Supt.Carponter.The prisoner was 23 vears of age and had been employed in the Post Office about one year.DISCHARGED.1 Michael Power and Joseph Brister, two youthful coal thieves, of Point St.Charles, were discharged in the Police Court this morning on account of their youth. They were arrested on Common street by Constable Murphy yesterday afternpon with over a hundred pounds of coal belonging to the International Coal Company, in their possession. The Company did not wish to: prosecute.) Medical Health Officer the last case of scarlet fever known to exist within the city limits has been isolated in the Civic contagious diseases hospital, and Dr.Laberge predicts that when this patient has been discharged scarlet fever will have ceased to exist in Montreal.Dr.Laberge says that this is probably the first time that the city has been free from searlet fever since the organization of the Civic Health Department. He added that he ascribed this satisfactory state of aflairs to the isolation system enforced by the department with the aid of the fever hospitals and to the satisfactory sanitary condition _of thecity.Dr.Laberge states that there is a continued decrease in the number of diphtheria cases and there are only eight cases in the Civic Hospital and bwa.thoroughly isolated, in private houses in the eity, With anything like good fortune Dr.Laberge hopes to be able to report that diphtheria has ceased to exist in Montreal before midsummer. The use of Roux’s serum is still being used in the treatment of diphtheria patients ut the civic hospital with varying success. On the whole the experiments with the new specific are considered sufficiently satisfactory to warrant Dr.Laberge to present a report to the Board of Health in favor of the establish- b ment of a bactereoclogical institute in con- ' nection with the Board of Health in Montreal. The report will probably be discussed at the next meeting of tlie Board.’ Dr.Laberge reports that quite a number of cases of measles of a very malignant form have been developed in the city and several adults have died from this disease.A couple of nights ago Dr.Laberge's mother, with whom the medical Health Ofticer lives, was called to the door by a hackman who: said that he ba a measles’ patient in legal adviser to the Association immobilière and Peers Davidson, legal adviser to the Good Government Society.I ‘conferred with both these gentlemen and a the matter with them very 1 happy to be able to state hat The Tight thrown upon Lhe subject by these two gen: tlemen helped me in a great measure to come to a conclusion. After giving the matter a great deal of attention, T can find no other statutory authority which seems to upon the case than the commission of inquiry provi: ded for by article 506 of the Itevised Statutes of Quebec. This article is to found under Title 111 ‘Executive Power,” chapter second “Inquiries concerning public mat- tera.” It reads thus **308.— Whenever the Lieutenant-Governor-in- Council deems it expedi © pro the conduct of any Lad big of the bli he Pron the administration of Justice, and such -inquiry upon the esmmisaloners by whom such inquiry isto .the power of summoning fore them any witnesses and of requiring them to give evidence on oath, orally or in writing, aud to produce such documents and things asx auch eolhmissioners deem roquisite to the full invostigation of the matters into hich they are appointed to examine.BV, c.& s.You will notice that authority i i given to the Licutenant-Governorin- to appoint a commission to enquire ¢ “into and concerning any mdffer connecled with the good.government of the province, the conduct of any part of the public business, or the administration of justice.” Now, it seems clear to my mind that the only wards under which such an enquiry as the one suggested could be authorized are the following: ‘The conduct of any part of public business.” But allow me to point out that the words “public buginess” mean, ,in their primary sense, busin WHICH CONCERNS THE GENKRAL PUBLIO and’ not the business which concerns the public of a particular municipality.Secondlv, that these words are insert tween the words “any matter connected with the good government of the Province” and the words “the administration of justice,” 50 that the context clearly shows that the expression ‘‘public business” can be ap- lied only to business which concerns the Pusiness of the Province. Two instances were suggested in hich an enquiry, such ax the one asked for, was held,” viz, one into municpal matters while the late Sir John Abbott was Mayor of Montreal, the other into the affairs of the School! Commission of Montreal.I will point out that the investigation held under the late Sir John Abbott's administration was not in virtue of any commission issued by the Executive f the Province, but wes held by a committee ofthe City Counetl as provided by the charter of Montreal. As to the second, it was held in virtue of the proyistons of the law from which article 506 R.S.Q.is derived; but I beg to observe that certain of the school commissioners are appointed by the executive and that the School Commission receives and distributes a certain sum of money which is each year by the Legislature; therefore this enquiry was held info the conduct of à part of the public business. In vistue of the statute, passed last session, 33 Vie.© 42, any person can sue by a qui tam action any member of à municipal council who is in any way interes ina eontract entered into between the corporation and a third party; the same remedy applies to the case of & member of a mun oh 1 council who derives any pecuniary Te muneration or benefit from such a contract, Then again the same atatute, section 5, provides as follows : ue Cousall, ot Lany su oF pall on th Taunich i il.war a Tien tea Tr e 0 Superior Te We Sistrict fa ju Ex city or EE hey in situated, in term vacation, require such ju to ane it fon, of one or more of the council or here x Pa 2 of any rson or persons a n ee at u or oon ntraote Shorewith hicpaut cave © council of any or muniol fi ing auiny to be A into or on ADT ma tor or Eyer conduc o of the publ ee ainons (here.the el at any time te make wo inquiry.the judg von Taio fet Ch Jes shall, for that purpose.hava all the js hich are conferred by this or or ance or any av res ting inquiries concerning pnblic he judge shall eantinue much inquiry day to day, with all souvontent des; and report to to tho Council the uiry and the evidence taken tl & tn making his re Ths oF the city o dx part © tition the ae sb il after hat, ports Shall also re costs. You will notice that this section gives the.judge much the same authority and power which are vested in the commissipner mea in wirtno of article 5 the bas been Shjected that the acts coming been.committed before he omg Into force of lr statute nm M ect 3 bol n Ci he soute as wise would be iving it he cat be effect 1 AM NOT RHADY TO AGREE with this contention. The atatute in question does not create any new pffence and ia simply * matter of procedure; it provides 7e which the trqth ean be reached in relat to certain acts done.1 refer iy to section 8, "whi las Shad our Sogn stisntion to article 156 of the = Code, 1802," which reads oy = (mo ls wufity of indict ble of Rvery " Thm Xen 1 cta oe and lisble to amd dollars and ars, and to imp: is ton o years and n and in defagit % payment of such fine to im- prisonmebt fo for a farther term nm vague six months, who directly or indi ” I Toakes any es 43 three 55 nt | Bho boviden advantage - we.for the purposes o 12a fora AA on 3 = a te inure ne To the Honorable The Premier of the Pro- | eo EE ESE oF committee; or rota to py or give any money or our materiel compet: Sr tonside ration to apy member or to any © cor ‘a municipal council for the purpose md acto?bim te in procuring or preventing any vote x Ragas of any outract or DE EVANS in favor any apy person; oe pose of oer fn: rforming.or CE 2 procuri or proventing ortance “a belure member or oftiver of & « municipal council, accepts or consents to accept any such offer, pro romise, agroemen: com on aa in in this sec tion ore mentlaucd; or in conaid thereof, votes or abatains from voting in favue of or Sains any measure, motion, revolution or question, or perform or abatains from performing so b; threat, deceit, y any threat, deceit, suppression of the truth or other unlawful means wo jt of a giving oats Di his vote in tasor of or against any ineasure, motion, resolu question, or in uot attendi any: meeting of the municipal conneil of which he is & momber, or of Any committee Thereof: o He) }'Attempts y Any auch ans as in thonext receding graph mentioned to influence any member or any oflfoor of à municipal council to aid in procuring or preventing the passing of any vote or the granting of any oontract or advantage in favor of any person, or to perform or abstain from performing, or to aid in procurin or proventiog the performance of, any offick ac!
