railway, and have laid steel rails for a le track over the whole of that distance, paying for righ of way ot bigh rates EXPLOSIONS OF GUNPOWDER.- One Man Kflled and Two Fatally Injured\u2014 Valuable Property Destroyed, LonDoN, Ont, Feb.18\u2014At twenty minutes to ten o'clock this morning an explosion occurred in the wholesale hardware establishment of Hobbs, Osborne & Hobbs, Richmond street, near the Tecumseh House, which shook the business portion of the city for three hundred yards around.The cause is supposed to have been the ignition of about twenty pounds of gunpowder which waa kept in the fourth story of the building for filling smal] cans when required by cus- n smaller quantities than a keg.From what can be learned, it is feared that the explosion was occasioned by emplo = of the firm, who, in order to enjoy a smo had lett the office and ascended to the top.These were Percy Inoe, the shorthand writer, and Frank Shaw, the assistant bookkeeper.They met there Donald Smith, *ho has charge of the stock in the flat ah that is all that can be ascertaiped of the doings, as the latter is dead and the other two are s0 seriously injured as to be beyond hope of recovery.Next came the burling of Fe front of two of the stories in the street, accompanied by a terrific noise, which was heard for miles around.The ng (Robinson, Little & Co.'s © of glass was smashed tured on the burned off to about the anklo; his eyes were burned badly and his clothing was gone in many places.He and Shaw were jatef to the Goneral Hospital.The uilding was owned by the firm.LOSSES AND INSURANCE.Tbe three upper flats of the bullding, valuad at some $15,000, are a mass of wreckage.and nearly the entire stock hopelessly ruined.On a rough getimate, the stock was valued at some $50,000 DECISION.How Far Life Insurance Companies Are Liable, A most important judgment for Life Insurance companies was rendered this morning by Hon.Mr, Justice Mathieu.The case was that of J.A.Boyce vs.the Phenix Mutual Life Insurance Company for $3,000.The circumstances are briefly as follows : \u2014 William A.Charlebois insured his life with the Company, some vears ago, for $3,000, and the polley was subsequently transferred to the Plaintiff Boyce.One of the conditions mentivaed in the proposal for insurance and in the policy, was to the effect that if the lusured should become so addicted to the use of intoxicating liquors, as to materially impair his health, the policy would becotue null and void.After Char- lebois\u2019 death, defendants refused to pay the claim flled with them un the ground that deceased had forfeited bis rights to the amount of his insurance by intemperate habits.Hence the present action.In rendering judgment, the Court held that it had beep proved by Charlebois\u2019 medical attendant and by his widow that after taking out the policy on his life he had become addicted to the use of intoxicating liquors to such an extent as to impair the insurance on his life ; that, according to the terms of the contract, it was not necessary that Lbe use of liquors should be proved to be tbe Immediate cause of bis death.and that consequent- IF judgment must
