of George H.Proctor, taken by Ty was read.It stated that Proctor had discovered the chance to make a haul from the Express Company, and told Donohue about it, that Donohue had put up the job and of the Arbitrators\u2014An Appeal To Bo Taken, The arbitrators In the St.John's bridge case have rendered their decision, which, however, will be appealed from by the heirs of the original proprietor, It bas long been known that the Quebec Government have taken steps to expropriate the bridge at St.Johns.The bridge connects the busy town of 8t.Johns with the opposite shore ot the Richelieu river at Iberville.lt was built, in 1826, by the Hon.Robert Jones under charter from the old Quebec Legislature, which extends the right of possession in perpetuity, the Government having the power after fifty agents to take possession of the bridge.There had besn no preliminary negotiations with the proprietary of any kind.Not only no money had been pald, it was even unknown what waa the amount asked.But hour from that Lime when the service of a declaratory paper had been made.Such an arbitrary course was naturally resisted, and there was no law to enforce it.Mr.Ryder immediately addressed himself to the Public Works Department of the Province, and about this time last year the Commissioner stated his intention to submit the case to arbitration, an: upon the heirs of the Hon.Kobert Jones to name their arbitrator.Mr.Kingsford, C.E, was appointed to act for them.After some weeks Mr.Telesphore Normand, of Three Rivers, was named the arbitrator of the Government.Early in December the arbitrators met, and Ît was agreed that the arbitration should be carried on in Montreal, Mr.Latiamme, QC.representing the ve rietary, Mr, Brosseau, on the part of Mr.acoste, Q.C., directing the case tor the Government.The two arbitrators could not agree as to the third arbitrator, and the consequence was that the decision was referred to the Superior Court, and Mr.Justice Caron named Mr.W.Shanly, M.P.The case was eventually brought before Mr.Justice Mathieu, who selec the name of Alderman Laurent, submitted by the Government Atwrneys.\u2018The arbitration commenced in the first days of March.\u2018I'he arbitrators personally visited the bridge and took full cognizance of its character and condition.Mr.Ryder produced witnesses Lo testify as to revenue when Mr.Brosseau objected to thia course.The consideration of this point was adjourned.Witnesses were examined as to the structure.The only profes- sldnal witness on the part the heirs Jones was Mr.Shanly, suppor by the clear evidence of Mr.Ryder, bimself an experienced builder and contractor.Several witnesses were called on the part of the Government.There was by no means a unanimity of value, some going as low as $11,000, the estimate of others reaching $20,000.The amount originally offered by the Government was $11,144 for a structure bring- lng an income.of $4517.67 on a perpetual charter, in good condition, and of which possession only can be obtained by paying full value.The principal witness when examined to substantiate his estimate in detail! was driven to admit the many omissions which were proved \u2014 and which considerably Increased his amount.Some of the witnesses gava arbitrary reasons their valuation, one going so far as to swear that he considered the bridge unsafe.But an engineer on the staif of the public works, Quebec, in answer to a direct question consider: that the structure was \u201cin good condition.\u201d The evidence being closed in this direction, Mr.Kingsford moved that evidence be taken as to revenue.This took place at the end of Avril.The motion was summarily voted down by Alderman Laurent, and Mr.Normand, when notice was served on them by the propristors that a writ of mandamus would be applied for at the Superior Court for this evidence to be received.1he case was argued by Mr.Laflamme, QC, and Mr.Doutre, Q.C., on the part of the proprietors.Judgment waa
