[" Fair and Warmer.=, 5 gg 338, \u201c23 : Vor.No.#88.y\u2014 : 052 PRC.TED THE CITY Terminal Railway Objects Delay in - Opening Forsyth Street.MR.MULLARKEY, GENERAL MANAGER OF THE COMPANY, FEARS THAT THE SUMMER WILL BE LOST.to The Montreal Terminal Railway yes- y served a notarial protest upon the city on account of the delay mn opening Forsyth street.Previous to this being done the company tendered to the city $1,900, being its share for the necessary expropriation of land, but the money was refused.In its protest the company claims that as a result of the city\u2019s neglect the company is liable to be subjected to serious loss, for which the city will be held responsible.The subject of the opening of Forsyth street was before the Road Comm'ttee y y and was referred to the city eyor to prepare plans, estimates cof the.cost; action by one of the heirs of the late Archibald Melntyre, who claimed that the rendering of an account for moneys advanced to some of his children by her father, as ordered by a clause in his will, could not apply to a sum of $5,000 applied on a property at Winnipeg which he gave her.The Superior Court dismissed the action, but the Court of Review reversed that judgment, Judge Taschereau dissenting.COURT OF REVIEW INTERESTING JUDGMENT ON A NOTE.In the case of the Pillow-Hersey Manufacturing Company vs.perance, the plaintiffs claimed $128.26, amount of a promissory note given them by defendant, and which was destroyed in the Board of Trade fire.The defendant pleaded that he was ready to.give another note upon plaintiffs furnishing him sufficient guarantee that he would never be troubled about the first note, but that the simple assurance of the plaintiffs themselves that he would never be so troubled \u2018did not constitute legal and sufficient security.The Superior Court maintained that plea and dismissed the action.In confirming that judgment this morning the Court of Review held that the law on letters of exchange, which requires security to be given in the case of
