reassembled at four o'clock, Mr.YL.0, David, City Clerk, delivered à most eloquent address, protesting against the Invasion of the municipal rights cortravened by section 10 of the bil to Incorporate the Heat and Light Company, under which section the company will bave leave to do what it may see fit .n the streets of Moutreal and in the streets of any municipality within fifty miles of Mantreal, subject only to the direction of the municipal autherities.Mr.David urged very strongly that the prier consent of the municipality Interested shenld also he obtained.and, In support of his contention, quoted the authority af the chairman of the committee himself who, In 18908, being then also chalrman of the committee, assured a delegation representing the City of Montreal that no further invasion of the rights of the city to the com- rand of its streets would be permitted, in which declaration he received, at that time, the support of the then members of the cor mifiee, Moreover, Mr.David quoted from the city charter, section 530, assented to by Me Legislature, no longer than two years age, in which the doctrine is laid down that no franchise shall be operative in the streets of the city without the prlor consent of the Ceunecil, Here are the words of the clause: \u201cNo person, partnership, syndicate, company or corporation whatever aball have or exercise any franchise, right or privilege In, over.npon or under any street, lane, public place or highway, (Including Mount Roral Park and St.Helen's Island) for constructing or operating any etreet or Incline rallwiys \u2014whether surface, elevated or underground or for tbe establishment of tele- pbonie, telegraphle, pneumatic or traction systems, or for other like purposes, or for poles, wires, bridges, trestles, viaduots, cubles, pipes, copdults, or such llke apparatus, unless by and In virtne of a by-law duly passed bv the affirmative vote of the absentee majority of the members of the Ccuvnell, if such franchise, right or privilege be granted for a pertod of not longer than five years, and of two-thirds of the Council If the same be granted for a period longer than five years, whether such franchise, right or privilege be exercised, or is scught to be exercised under letters patent.\u201d The Leg!slatnre having consecrated the principle of munietpal control over its own streets, should TALK, Ald.Lebeuf followed in a temperate but at the same time extraordinary forcible speech, which was followed with the closest attention pot ouly by the members of the committee, but by all others in the room, Mr, Lebeuf first defended the principle that the municipality has the right to say under what conditions, by whom and for what purposes ite streets may be used, He next reminded the members of the committee that the prople of Montreal und of the province have been aceustomed to look to the Legislative Counctl for careful and wise consideration of all measures sent up to them by the Lower House, to place a check upon lmproper legislation asked for by interested persons agninst the pub- lle good, and hastily, improperly, or without due consideration approved by the legislative Assembly.He pointed out that whatever might be sald of the Assembly, the members of the Council could not plead ignorance of the sentiments of the people of Montreal, for, as a consequence of just treatment by the Counrl] on pre.vlous occasions, the representatives of the city felt that they were amply discharging thelr duty to the people In bringing all the facts before the members of the Legla- lative Couneil.\u201cYou represent the sober, second thought of the province\u201d said Mr.Lebeuf.\u201cThat iz why your house fs continued In existence.1 am, as you know, an old TAberal, but J have opposed the abolition of your chainber because I have believed that your desire to proteet the people from the consequences of improper legisiation justitie< yonr retention as part \u2018It Is not alone Montreal that is interested In securing the affirmation of this principle,\u201d sald Ald.Lebeuf.\u201cIt affects .the Interests of many other important places, St.Henrl, Westmount, St.John's, St, Hyacinthe, La- chine and many more.\u201d GIVING AWAY TIB PROPLE'S PROPERTY, Hon.Dr.Guerin, who protested against the clause as an invasion of the rights of his constituents, called the attention of the committee to the fact that by giving he company the right to use the streets for almost any purpose they choose without being required to consult the mun): cipal authorities, they would be making the promoters a present of a franchise worth many millions, a franchise which it was for the people of Montreal and #r no one else to dispose of.In reply, Mr.Campbell asserted that other companies had received similar charters without making use of them, with the exception of the Standard company, which had peddled out part of its frapehise to the Lachine Company.Mr, Campbell argued that it was improper to force companies to get the consent of the city, as sometimes that consent could not be re- celved for six months or more.AMBNDMENTS REJECTED.At the evening session Mr.Ethler proposed as an amendment that the \u201cconsent\u201d of the city should be required, in the spirit of section 540 of the charter.At ten o'clock ibe public were excluded, and when they were allowed to return, which was in a very few minntes, the chairman said: \"We have considered the amendment and have rejected it.\u201d It twas learned afterwards that the vote stood 13 to 7.Mr.Ethier then proposed several other amendments intended tn modify the clause, but they ton were rejected.THIS MORNING'S SESSION.Quebec, March 22,-(Speclal.)-The amendments which have been suggested by the city of Montreal to the Light, Heat and Power Company's blll, now before the Private Rills Committce of the Legislative Counell, were taken up at this morning's session by Mr.Campbell and discussed briefly.He spoke of the proposed clause to the effect that the company should not destroy shade trees, and said that the company would he wllling to accept that If the words \u2018\u2019except when necessary'\u2019 were added.The company was willing to pul the streets back in the same condition as before aud to be responsible for wires destroyed by \u2018flreman.As for the clause that the city should have recourse in warranty against the company, Mr.Campbell said that these questions were fully covered Ly the common law, and he did not see the necessity for it.The proposed wording of clause 16 would force the company to get the consent of the city under section 559 of the amended Montreal charter, and that was simply going back to the question settled yesterday.Mr.Atwater, on behalf of the city, said he would pot rehash the arguments of yesterday, but he wished to say that the concessions offered by the company were of the most shallow and most unsubstantial nature.\u2018Nothing that they have conceded ls not covered perfectly by the civil law.Thede amendments which the city of Montreal had proposed as a dernler resort owing to the fact that the principal amendment that they relied on to safeguard the Interests of the city of Montreal had been re- jeeted by the committee,\u201d sald Mr, At- water, 'l wisn formally to put myseif on record to the effect tbat we do not abate one jot or one tlitle of our demands, We are pot satisfied and we do not agree on any compromise.I hope the hon, members will take this into consideration when this matter comes before the Housel\u201d Mr.Dunlop and Alderman Laporte, who spoke briefly, took ihe same course.The room was then cleared and the committee unankmously passed the bill with the amend- ents.In the Private Bills Committee the bill to incorporate the Metabouchouan Pulp Company was discussed and finally passed with uumerous amendments, An excellent suggestion was passed In the Legislation Committee thix morning.It is to the effect that hereafter no bills to amend any of the codes can be introduced before the House unless they have been submitted to the Attorney General at least two weeks before the opening of the House, Ifethis can be passed it will do away with much of the trivial law tinkering that cguses so much trouble with so little result, Bill \u20ac of the Counell, to the effect that Ralleitors General, Deputy Ministers of Justice and Registrars of the Supreme Court and the Exchequer Court should be admit- ed to practice law in the Province with- ont examipnailon was thrown our by the Legislation Committee as also was Mr.Pelletier's bill regarding judicial separations.Mr.Chicoyne\u2019s measure for the establishment of en-operative associations was continued until next session.The town, of Richmond amendment to Its charter was dismissed in the Private Bills Committee of the Counell and went through with but slight amendments, Mayor Prefontaine\u2019s Little Bill Was
