d\u2019un Acte pussé dans la quutorzième unnée \u201c\u201c du règne de Sa Mujesté intitulé, \u2018\u201c\u201c Acte qui pourvoit \u201c plus efficacement pour le Gouvernement de la Province de ** Québec dans l'Amérique Septentrionale, et qui pourvoit plus \u2018© amplement pour le Gourernement de la dite Province,\u201d il a été entre autres choses statué que dans tous les cas ou les terres seroient en ci-après uctroyées dans la Province du Bas Canada,et ou le Concessionaire d\u2019icellés désireroit qu\u2019elles soient octroyées en franc et commun socéage, elles seroient ainsi octroyées, sujettes néanmoins à tels changemens quant à la nature et aux consequences de telle tenure en franc et commun soccage, qui pourroient être établis par aucune Loi ou Loix qui pourroit se passer par Sa Majesté, ses Héritiers et Successeurs, par et de l\u2019avis ct consentement de Son ou Leur Conseil Privé : Et attendu que par un Acte passé dans la sixième année du règne de feu Sa Majesté le Roi George Quatre, intitulé, Acte qui pourvait à l'extinction des Droits 6, G.4.c.59 et charges l'éodaux et Seigneuriaux sur les 908 00 °° terres tenues à titre de ficf et à titre de cens dans la Province du Bas Canada, et au chungement graduel de ces tenures ex lu tenure de frunc et commun soccuge, et à d\u2019autres fins relatives à la dite Z'rovince, après avoir mentionné, qu\u2019il s\u2019étoit élevé des doutes si les terres octroyées dans la Province du Bus Canada par feu Sa Majesté le Roi George Quatre, ou par aucun de ses prédecesseurs Royaux, pour être tenues en franc ct commun succage, seroient tenues par les Propriétaires d\u2019icelles, ou passeroient ensuite à d\u2019autres personnes, selon lcs règles de succession et aliénation en force en Angleterre, ou selon telles règles qui étoi- ent établies par les anciennes loix de la dite Province relatives a la Succession ctaliénation des terres y situées, c'est pour quoi, il a été déclaré et stutué, que toutes terres dans la dite Province du Bus Cunadu, qui auront été oe- troyées pair feu Sa Majesté susdite, ses héritiers et succes- scurs, a aucune persone ou personnes, leurs hoirs et ayans cause, pour ê\u2018re tenues en franc et commun soccage, ou qui seroient ou pourroient être ci-après ainsi oc.royées par feu Sa Majesté susdite, ses héritiers et Successeurs, à aucune personne ou personnes, leurs hoirs et ayans cause, pour étre tenues en franc et commun soccage, pourroient être et seroient par tels Concessionaires, leurs hoi.s et avans cause, tenues, concédées, vendues, aliénées, transportées et disposées, et pourraient passer ct passeraient en Succession en telle manicre et forme, etsur et en ver tu de telles règles et restrictions, qui sont parialoi d'Angleterre établies et en force, relatives à l'octroi, marclié, vente, aliénation, transport, disposition et suce ssion des terres tenues par la méme tenurve y situées, ou au duvzire ou autres dvoits des femmes mariées sur telles terres et non autrement, non-obstant aucune loi, coutume, on usage à ce contraire : Etila été par là pourvà, que rien y contenu tendroit à empêcher Sa Majesté, de l\u2019avis et conseu- tement du Conseil Législatif et de l'Assemblée du Bas- Canada, de faire et statuer aucumtes loix ou statuts qui pourraient être nécessaires pour mie x adopter les règles de la Loi d'Angleterre ci-devant muntionnées, ou aucunes d\u2019elles, selon les circonstances et conditions de la dite Province du Bas-Canada, et de ses habitants : Kt va qu'il s'est élevé des doutes si Sa Majesté, de l'avis et consentement du Conseil Législatitet del\u2019Assemblée, était com- pétante à fuire et statuer aucunes Loix où statuts réglant la Succession des terres ainsi octroyées en franc et commun succage comme susdit ou concernant l\u2019octroi, marché, vente, aliénation, transport ou di: position de telles terres vu concernant le douaire ou autres droits sur ou à telles terres en ancun cas où telles règles sont contraires ou en contradiction à la Loi d\u2019Angleterre ;
