[" \u2014 VOLUME VIIIL.\u2014No.15.THURSDAY, FEBY, 10, 1831.Brsette de Quebec.TOME VIIL\u2014No.15.JEUDI, 10 FEVRIER, 1831._- 15e mm ar mts ett EERE The 5th day of November 1830, PRESENT, The King\u2019s Most Excellent Majesty in Council.Wh EREAS by a certain Act of Parliament, passed in the sixth year of the reign of His late Majesty King George the Fourth, intituled\u2018\u2018 An Act to regulate \u201c the trade of the British possessions abroad,\u201d after reciting, that \u2018\u2018 by the Law of Navigation foreign shipsare per- \u201c\u201c mitted to importintoanyof the British possessions abroad, ** from the countries to which they belong, goods, the produce of those countries, and to export goods from such possessions to becarriedto any foreign country whatsoever, \u201c* and that is is expedient that such permission should be subject to certain conditions,\u201d it i8, therefore, enacted, \u2018¢ that theprivileges thereby granted to foreign ships shall be \u201c\u201c limited to the ships of those countries which, having colo- \u201c* nial possessions, shall grant the like privileges of trading \u201c\u201c with those possessions to British ships, or which, not ha- \u201c* ving colonial possessions, shall place the commerce and \u201c* navigation of this country, and of its possessions abroad, \u2018\u201c upon the footing of the most favoured nation, unless His \u201c\u201c Majesty, by His Order in Council, shall in any case deem ¢¢ it expedient to grant the whole or any of such privileges \u2018¢ to the ships of any foreign country, although the conditions aforesaid shall not in all respects be fulfilled by such \u201c$ foreign country :\u201d And whe:eas by a certain Order of His said late Majesty in Couneil, bearing date the twenty-seventh day of July one thousand eight hundred and twenty-six, after reciting that the conditions mentioned and referred to in the said Act of Parliament had not in all respects been fulfilled by the Go- verninent of the United States of America, And that therefore the privileges so granted as aforesuid by the law of navigation to foreign ships, could not lawfully be exercised or enjoyed by the ships of the United States aforesaid, unless His Majesty, by His Order in Council, should grant the whole or any of such privileges to the ships of the United States aforesaid : His said late Majesty did, in pursuance of the powers in Him vested by the said Act, grant the privileges aforesaid to the ships of the said United States; butdidthere- by provide and declare, that such privileges should absolutely cease and determine in His Majesty\u2019s possessions in the West Indies and South America, and in certain other of His Majesty's possessions abroad, upon and from certain days in the said Order for that purpose appointed, and which are long since passed : And whereas by a certain otherOrder of His said late Majesty in Council, bearing date the sixteenth of July one thousand eight hundred and twenty-seven, the said last mentioned Order was confirmed : And whereas in pursuance of the Acts of Parliament in that behalf made and provided, His said late Majesty, by a certain Order in Council, bearing date the twenty-first day of July one thousand eight hundred and twenty-three, and by the said Order in Council, bearing date the twenty-seventh day of July oue thousand eight hundred and twenty-six, was pleased to Order that there should be charged on all vessels of the said United States, which should enter any of the ports of His Majesty's possessions in the West Indies or America, with articles of the growth, produce, or manufacture of the said States, certain duties of tonnage and of customs therein particularly speci- eq And whereas it hath been made to appear to His Majesty in Council, that the restrictions heretofore imposed by the laws of the United States aforesaid upon British vessels, navigated between the said States and His Majesty's possessions in the West Indies and America, have been repealed, and that the discriminating duties of tonnage and of customs, heretofore imposed by the laws of the said United States, upon British vessels and their cargoes entering the ports of the said States from His Majesty\u2019s said possessions, have also been repealed, and that the ports of the United States are now open to British vessels and their cargoes coming trom His Majesty\u2019s possessions aforesaid, His Majesty doth, therefore, with the advice of His Privy Council, and in pursuance and exercise of the powers so vested in Him as aforesaid, by the said Act so passed in the sixth year of the reign of His said late Majesty, or by any other Act or Acts of Parliament, declare, that the said recited Orders in Council, of the twenty-first day of July one thousand eight hundred and twenty-three, and of the twenty-seventh day of July one thousand eight hundred and twenty-six, and the said Order in Council of thesixteenth day of July one thousand eight hundred and twenty-seven (so far as such last mentioned Order relates to the said United States), shall be, and the same are, hereby respectively revoked : And His Majesty doth further, by the advice aforesaid, and in pursuance of the powers aforesaid, declare that the ships of and pelonging to the said United States of America, may import from the United States aforesaid into the British possessions abroad, goods the produce of those States, and may export goods from the British possessions abroad to be carried to any foreign country whatever, And the Right Honorable the Lords Commissioners of His Majesty's Treasury, and the Right Honorable Sir George Murray, one of His Majesty's Principal Secretaries of State, are to give the necessary directions herein, as to them may respectively sppertain.JAS.BULLER.Proviuce of ! Council and the House of Assembly of this Province ; And whereas the said Bill, in the same session thereof, on the fourteenth day of March, in the year aforesaid, was presented to His Excellency Sir burthenson lands held a titre de fief and a titre de cens, in the Province of Lower Canada, and for the gradual conversion of those tenures into the tenure of free and common soccage, ard for other purposes relating to the said Province, it was among other things enacted, That it should and might be lawful for the Governor, Lieutenant Governor, or person administering the Government of the said Province with the advice of the Executive Council thereof, to constitute and appoint, by a commission under the Great Seal of the said Province, one or more person or persons to be a Commissioner or Commissioners of Escheatg and Forfeitures of land within the said Province, as by the said Act, reference being thereunto had, may more fully appear; and whereas his said late Majesty King George the Fourth, in pursuance and by virtue of the said Act, and with the advice of the Executive Council of the said Proviuce, was pleased by commission under the Great Seal of this Province, bearing date at the Castle of St.Lewis, in the City of Quebec, the fifth day of July, in the ninth year of his Reign, to constitute and appaint Andrew William Cochran, Esquire, to be his Commissioner of Escheats and Forfeitures of land within this Province; and whereas it is expedient that the powers by law vested in the Court of Escheats, established within this Province as aforesaid, be resorted to and carried It is thought that the Revolution and disturbed state of PoLAND will necessarily effect the BriTISsH CORN MARKET, should the crops be deficient in ENGLAND.LATEST NEWS.House or Commons, 17th Dec.1830.THE COLONIAL TRADE BILL, Mr.P.TroMpsoN proposed that the second reading of this bill should be postponed until after the recess, on account of the various interesis which were involved.During the holidays he would consider the subject, and see whether any measure could be prepared better calculated to protect the ditfe- rent parties interested.Mr.Merries had no objection to the postponement of the measure, though Le was confident that the late Government had well attended to the interests ofthe different parties.He trusted to the candor of the Right Hon, gentleman to proceed with the bill, if he could not discover a hetter measure, Mr.G.ROBINSON complained that the late Government had conceded to the United States a direct intercourse with the West India Colomes, to the injury of our North American Colonies, In doing that, the late Government said that they had acted on the principles of the late Mr.Canning and Mr.Huskisson, but he denied thatsuch was the case, Mr, Hus- kisson always declared that he never would concede such a boon to America without receiving an equivalent in return.In 1826, Mr, Canning, in his correspondence with the Minister of the United States, said, that he would not allow America to enjoy à direct trade with the West Indies, unless this country received an equivalent ; and it was promised that be- fote any arrangement was made all parties should be informed of the nature of it.But in spite of that promise, a negotiation took place and was concluded ; and the Canadas were only informed of the fact through the medium of the United States newspapers.In reading the correspondence which Lord Aberdeen, he could not lelp feeling surprise at the arrogant pretensions of America; and he thought the\u2019 whole atfair disgraceful to the British Ministers, under whose aus- pices it was undertaken, But he thought that if the Bill be- had taken place between Mr M\u2019 Lane the American agent, and.February 10, fore the House were now postponed, our North American colonies would labour under great disadvantages.The late government conceded the privilege to the United States of trading directly with the West India colonies, but reserved to themselves the right of regulating the duties they might choose to impose onthe importation of American goods: He had been told, however, and he should be glad to know whether he was rightly informed, that Mr.M'Lane had en- | deavored to re-open a negociation with the present government with the daring object of interfering with the Government in the regulation of the duties ; on the contrary, he wished that country well.But still, as an Englishman, he felt it right to watch her attempts at maritime aggrandisement with the closest jealousy, the rather as her shipping and: tonnage, as it was, ve nearly equalled our own, and would be augmented from 200, 000.to 300,000 tons by the Right Hon.Member for Harwich\u2019s: measure as it then stood.He wished to know whether there was any negotiation then pending between the American and the British Goverument in consequence of that measure.Sir H.PARNEL advised the Right Hon.Vice President of the Board of Trade not to answerso irregular a question.When the bill was first brought under the notice of the House hy the Right Hon.the Member for Harwich, he, Sir H.Parnel had declared it to be a violation of the newly concluded commercial treaty between the English and American States judging by the correspondence laid on the table, and was not therefore, surprised that America should have in consequence renewed the negotiations.The fact was, the Right Hon.Gen-~ tleman\u2019s measure was neither more nor less than an attempt to revive the old, exploded, and mischievous protecting system, as it was called, though, in fact, it would be no less injurious to our own, than to the interests of the Americans.He could not, indeed, suppose for a moment that so injudicions a measure would receive the sanction of the new government.If he thought so, he should feel it to be his duty to move for a copy of the correspondence that might have taken place between the English and American Ministers in consequence and, of course, since that measure, 2 Mr.HERRIES must appeal to the House whether it wae fair to it-to himsell\u2014to his late colleagues\u2014or to the question, to thus enter upon an irrelevant discussion on the merits of a measure which it was agreed on all hands should be postponed.In giving his assent to the postponement, he had studiously avoided provoking discussion though anxious to make a few remarks cn one or two topics involved in the bill, and yet he had noe sooner sat down than an attack was made on him and the late Government, and assertions and misrepresentations made, the fulsehood and absurdity of which he would take care to expose at a future and more fitting opportunity.The Hon.Member for Worcester was very irregular, not only in the question which he had just put, but in the assumptions on which he had grounded it.He said that America is right, and we wrong,as to the late treaty and in the measure consequent upon it.Now he (Mr.H.) in opposition to the Hon.member, and in possession of fuller and- more accurate information, would maintain that we were all along right, and America needlessly wrong.Propositions had been made, on the part of the American Government,to which the English Minister could not listen for a moment; but the treaty which had been concluded, and.the negotiations since entered into, would, he trusted, Le the means of a final and am cable adjustinent.He bez- ged the House not to conclude from his rot then entering into a fuller statement\u2014the proper occasion would present itselt very svon\u2014that he could not reply to the assertions.of the Hon, Member, and demonstrate their groundless.ness.His silence was wholly owing to what he felt, aud would at another time prove to be, à sense of duty.Mr.Hume hoped the Lill would be remodified in the recess, and brought furward in a shape more likely to promote the common interests of England and America.Mr.STEWART also trusted that the question would be brought forward in à more extensive and liberal form after the bolidays.Mr.P.T'HomrsoN would on the l1th of F-bruary next, call the attention of the House to the measure.The second reading was then pro forma (the bill being understood to be withdrawn) fixed {or the 11th of February.INSURRECTION IN POLAND, (From Bell's Weekly Messenger of December, 19) The foreign intelligence of the week is of more importance than usual, inasmuch as it brings information of a reat Revolution: which has taken place in a part of Europe where the sun of freedom seemed to have set forever.We allude to the revolt of the Poles inthe Russian provinces, the flight ol the Archduke Coustantine,.and the establishment of a Provisional Government at Warsaw.Though in-a more distant quarter of Europe, we con- \u2018fess that we look to this revolution with more satisfaction than to that which has recently occurred in France or Belgium.Poland has been oppressed by the unrelenting hand of despotism for many years.It had not the least shadow of free institutions, but was under.the sway of pure unmixed despotism\u2014a despotism not contented with a mere civil tyranny, but besetting the paths of domestic life, and polluting even the privacy of the chamber with- a-degrading system cf espionage.The oppression which the Russians practised in Poland san scarcely.be believed, Noman in any station of lite was permitted to marry or to dispose of his inheritance without a license from government.\u2014 Most persons possessed of any influence were compellcd to live in solitude upon their own estates, and not permitted to pass even the frontiers of one province to another without a puss- port obtained by the most degrading supplications.\u2014 \u2018Phus, whilst the Russians were travelling in every quarter of Europe, a Polish traveller was scarcely somuch: «s- seen.Poland was imprisoned, as it were, withirt berown- frontiers, and kept for the gloemy pleasure of.Russia, who exhausted every species of tyranny and exaction upon tbe people.Every mind of eommon feeling must rejoice at the at: tempt made by such a people, be the event what it may,.to regain their freedom.Whatever sympathy may be excited for France and Belgium, it muet be recollected that they were already in.possession of liberad forms of government ;.whilst the Poles were almost the only une- wancipated alaves in Europe\u2014the dark feudal ages; and which will amply repay the attention of those who are desirous of making observations on the progress of this Eclipse.The Solar Eclipse of February next\u2014The American Almanac, just published, contains a great variety of calculations relative to the great solar eclipse which will be visible throughout the United States, on the 12th of February next.These calculaiions exhibit very minutely the path of the central eclipse, at a large number of places in the United States.The path of the eclipse is still more clearly marked out upon a map of the United States, attached to the almanac for the purpose.The central eclipse will enter the United States from Mexico, and will pass through the states of Louisiana, Mississippi and Alabama, the north part of Georgia and South Carolina, North Carolina and the south eastern parts of Virginia and Maryland ; the broadest part of the solar crescent being then about the middle of the upper quadrant on the eastern side.At 4] minutes and a half past 12 at Quebec, the sun will be centrally eclipsed on the meridian in Anson County, in the State of North Carolina, about 970 miles south, 37 degrees 20 minutes west, of that city; the recollection of which circumstance will enable our astronomers to compare the appearances at the two places, and to judge, from their own observation, of the effect of a difference in the position of the spectator on the phase of a solar Eclipse.You will find that at this moment about two-thirds only of thesun\u2019s diameter will be intercepted by the body of the moon from the view of the inhabitants of Quebec ; the apparent distance of the centres at that place being between 10 and 11 minutes: which difference is, as you know, the angle under which the portion of this continent intervening between Quebec and the place already mentioned, will appear to the lunar astronomers, who may, possibly, at the time be observing the penumbral eclipse of their own magniticentsatellite, which will at that moment be presented to their contemplation.About this time the solar crescent, still continuing to diminish in breadth, will appear to begin to revolve gradually about its own centre from left to right, withan accelerated motion, the convexity verging more and more towards the summit of the disk ; so that in about 17 minutes; viz: at 58 minutes and a half past 12, it will appear in a horizontal position, with its convex side towards the zenith, and its points turned downwards; the centres of the two luminaries being then on the same vertical.1ts greatest breadth at this time will be only about one-seventh of the sun\u2019s perpendicular diameter: that is to say, between 4 and 5 minutes of a great circle.\u2014 This dazzling crescent will now appear to continue its revolution at the rate of between 4 and 5 degrees in a minute ; so that in somewhat less than 22 minutes from the moment of its being in a horizontal position, it will become vertical, the convexity being turned towards the right of the spectator; that is to say, towards the west.\u2014 At 20 minutes past 1, a plumb-line would iutersect the extremities of both the cusps.Its breadth, which will first diminish and afterwards increase during its transition from its horizontal to its vertical position, will now be somewhat greater;
