Causes or TBE RivTs.— What led tu the disgraceful scenes of violence ov the day aud night of the election ?This question is easily answered. In the first place, a riotous spirit had been escited by attempts, eucouraged in high places, to break up the public meetings revenily held ei the Exchange, gt tbe National Hall, and at Washington Hall, because it was suspected Dy sume uuprincipled partizans that those meetings were friendly to Mr.Tyler.—The wfernal spirit of brutal violence having been thus unchained, was excited on by inammatory appeals ip certain newspapers, Some guss had been fired iu the Parl in bouvr cf the Connecticut election; the Cominercial Advertiser at once proclaimed them to be the © Thunders of the Vatican,” falsely assuming that they were fired by the Catholics in honor of the Schuul bill.Upon these premises it uttered some counter thauders, which were calou- lated to arouse sectariau animosity, and were very far from being iu the spirit ot the founder of the Christiso Church, Many similar appeals were made lu our opinion the writers of such articles, aud the fomenters of the rivtous conduct at the several political meetings ty which we have alluded, are chargeable with all the violence which has disgraced the city Où this occasion.(1b) {From the New York Evening Post } Disaracerut RivT.— The elections yesterday, in every part of tite city, were conducted with great quiet aud order unt:] about two o'clock in the after- i noon, when a disturbance was commeuced in the sixth ward, by a baud of disorderly fellows, kaown as the Spartaus.lt began by the upsettiug of the | boxes in which the whig tickets were kept. After having demolished the buxes in the sixth ward, the party proceeded, in the same way, up to the eleventh ward, aod su down through the thirteenth to the seventh. While they were absent trom the sixth ward, a body of Irishmen had urganised themselves, fur the purpose, as they said, of defending the polls aud keeping the peace. They paraded the streets, Huurishiug their clubs, but assaulted no one, The timely srrival of the Mayor, iuduced them to lay down their arms, and to prowise to disperse. But as some of them were guing home they tell in with the Spartans, who were returning fiom their riotous excursious into the upper wards.Words of tannting, aud of religivus aud nativnal allusious, excited, vo doubt, by the iuflammatory appeals which have lately beeu addressed to vulgar prejudices frum certain presses aud pulpits in the city, passed between them, and a severe collision soun took place. The vumbers on both sides were suon swelled by their respective friends, uatil two or three huudred persous were actively engaged in the ‘ fekt. The Irishmen were driven from ihe field, when the Spartans, emboldened by their success, mide an attack upon the Sixth Ward Hotel, kept by J.Dunn, breakiag the windows, overturning bars, and demolishing the furniture. At this time, some designing persons, miugling with the mob, sought to take advautage of their fury, by directing it against the Catholics. It was moved that they should pay a visit to * the politienl Bishop,” weaning the Right Reverend Bishop Hughes, which wus {instantly curried, and the multitude adjourved tu “the neighborhood of the residence of the prelate.! Here the Irishmen again assembled to protect the i house of their pastor.A scuftle ensued, in which ; several persvus were seriously irvjured, The glass "of the huuse was dashed in, and cousiderable damago ; done tu the front rooms. The arrival of a police | force, uuder the Mayor and Justive Taylor, dispersed the rioters for a time; but shortly alterwards they came together agaiv in the vicinity of the Ca- | thedral. Two or three brick bats were throwo at the building ; Lut a troup of horse huving been ordered out by the authorities, the rioters were ! not suffered tu cuntiuue their dastardly and disgraceful proceedings.re ma ay © ep SNR fae 2 en eme NE 6 $n cat ares SAS 8 .5 2 Kad MD jh hi hile D RH ?0 } sri ns Albany, April 15.Tha annual election for ward an d charter uifieers, which was held in this city yes.ter day, torininated in the sucerss of Bareat P, Staats, the Loco Foco candidate for Magar, by a large majority, and in the election of 9 Whigs and i! hie action a declinatory exception has been fyled by the Defendant.lu this, itis olleged that this Court has no jurisdiction over the subject matter of the suit, —because His Excellency Sir Richard Jacksoi, as Administrator of the Goverument, by his proclamation dated lst December last, divid- «d that part of the Province which is called Lower Canada, (with the exception of the Inferior District of Gaspé,) into certain Districts, of which the Inferior District of Quebec is one, and in the latter distriot appointed the City of Quebec as a place at which the District Court was to be held therein: and because William Power, Esquire, by letters patent under the great seal of the Province, has been appointed District Judge of the Inferior District of : Quebec : and because the sulject matter of this suit | is within the exclusive jurisdiction of the District Court of Quebec.; but the consideration, as well of the arguments which have been used as of the authorities which have been cited, is reuder- ed altogether unnecessary, by the view which the Court takes of this subject. The Statute referred to in the pleadings, after enacting that the Province shall bo divided into“lofe- rior Districts, and that the District Court shall be held at a place to be appointed in each, then proceeds in the 4th sect.to enact, ** that the said Dis.* trict Courts, to be held as aforesaid, shall severally “have, except in the cases therein alter mentioned, “ cognizance of, and from and after the first day of “January neat, after the passing of this Act, shall “ bave exclusive cognizance of, and full power, juris- “diction and authority to hear, try, and determine “ina summary manner, all suits or actions, (those * purely of Admiralty jurisdiction excepted) wheres “10 the som of mouey, or the value of the thing de- “ manded shell exoeed six pounds five shillings cur- « fency, aod shall not exoeed twenty pounds ster- “ log» This clause imports a repeal of the Jurisdiction of this Court, in respect of the suits therein mentioned, from and after the first Jannary last, the Words “exclusive cognizance,” ws they are found In this clause, having the same effect, asif in express and formal terme, it had Leen declared that, from and after that day, this Court should conse to have Jariadiotion over such suits. The case bas Leen argued, as if the power of this Court was to cease, Bot on à cettain day, but on the establishment of District Courts, and if such had been the language ofthe Legislature, the validity of the establishment of those Courts, involving that of the Proclamation referred to, would bave come in question, under this deolinatory exception. But the Legislature has not thus expressed itséll.On the contrary, by the clause above recited, the Legislature fixed pros Pititvely » futare day, on which the jurisdiction of the Courts of Kiny Canada, of King’s Bench, throughout Lower + La Was to cease i—the moment that day was] guished, without reference to the legality or illegalit of the establishment of the District Courte Thy only question, then, befors us, being whether this Court bas or bas not jurisdiction, and our jurisdio- tion baving Leen clesrly taken away, we are not called upon, and it would be foreign to our duty, to inquire, whether the newly established Courts, to whiol; it was the iutention of the Legislature to transfer the Jurisdiction of the Courts of King's Bench, have Leon legally constituted or not: it is sufficient, for the determination of ihe question raised on this jseue, that this Court has, by the enactment of the Legislature, been deprived of its Jurisdiction, over the subject matter of this suit. The Court being of this opision—the judgment is, that the decliuatory exception ba maintaiued, and that this notion be dismissed with costs, (Mercury.)
