Titre :
Morning chronicle and commercial and shipping gazette
La ligne éditoriale du journal est définie comme suit : « [.] in the management of The Morning Chronicle we shall, therefore, begin by simply declaring, that, as we glory in our connexion with the British Empire, it will be our undeviating aim and unremitting endeavour, to create and foster a cordial attachment to those time-honoured institutions which have made her so illustrious in the annals of the world ». (May 18, 1847, p. 2)

[Traduction]
Voici les différents titres que le Quebec Chronicle-Telegraph a connus depuis ses débuts : Disponibles en ligne : The Morning Chronicle (Jan. 1847 - Nov. 1850) The Morning Chronicle and Commercial and Shipping, 1850-1888 The Morning Chronicle (Feb. 1888 - May 1888) The Quebec Morning Chronicle, 1888-1898 The Quebec Chronicle, 1898-1924 Non disponible en ligne : The Chronicle Telegraph (1925-1934) The Québec Chronicle-Telegraph (1934 à ce jour)

shouting for tbe police, and happened to meet two or three men oi the force on duty.Their presence did not however prevent his pursuer from striking him a severe blow across the face, when be was at respect to the withdrawal of Lt.-Gols.Crawford, McKay, Htevensou and LaBranche from the Quebec Brovincial Association, the facts are as follows : The above named gentlemen being desirous of re-instating Hergeant Wynne and Wilson in their privileges of members of the Provincial Rifie Association, from which these Sergeants had been expel-led; presented a motion to that effect at the meeting of the above association held on the 21st instant at Pplùt St.fJharles.The motion was not carried, and the tit.-Colofie^s, Crawford, MeK*y, H evensou and LaBranche, resigned as members of the It is the intention ôï the ccatrectord during tbe coming winter, to construct another dreÿge, apd haye it ready to commence opoiktfous next spring. The City Streets.—Tbe present condition of Ibe state of affairs.Yalier street from Dorchester to St.Ours, is full of bole*, about ten per cent of tbe entire number of planks with which it is supposed to be coverea, being missing. It requires the exercise of the greatest caution in driving over this portion of street, to pfovent a breakage of axles. As soon as the HL Sauveur division line is reached, a decided improvement is noticeable jn this it should be complied with in ‘tbla particular, and the claim most contain mt armant. In the case of a claim by a partnership the uarnes of tbe partners composing It muse be given in foil, or at leaat the'r name snd one of their sornanres.Tbe claimant matt be identified and described. It would not be «nffiefout to indicate an individual claimant t>y hia initials ; the name of Ibe firm without fihose of da members is no better The assignee or even some of the creditors, Bif tbe estate, which assumption, io the case of different properties or effects, may be of one, or several of the whole.1 am of opinion therefore tbat a claim which doe# not give a aufficieat description of efich property and effects constituting tbe Security and their separata value is irregular and in-lormal find should he rejected, and the more so if, as In onp instance in the present case tbe creditor otatps fhe value to be so much and mo s, which more mpy cpycf the whole claim.Section 104 requires tbat tbe claim# be attested under oath, and section 105 says before whom, in and out of Canada, such oatb may be taken. The law makes no exception, and a claim made in Great Britraiu aud there attested under the provisions of the statute which substitutes attestation to swearing in certain cases is cot a proved claim under our statute ; one is rejected on that and other grounds.Section 29 of tbe Act says that “no creditor shall vote at any meeting unless present personally or represented by some per.son having a written authority, to be filed with the apalgnee, to act at any such meetings on bis betajf,” and tbe part of sec-liou 102 already cited «entions the same rule in more presise iangnpge. The autberi y must be conferred by persons bayr ing that power, that is tbe creditor himself or his agent when the latter ia himself empowered to delegate his own authority, but then tbe authority pf tbe agent to appoint another in bis place, and tfori pf the person whom be bas chosen to represent f b.e creditor at tbe meeting mast both be handed tbe assignee. This rale should uot however, I think, bp .SO rigidly enioretd as to require Irom tbo manager of a corporation, such as tbe cashier or prealdept of n bank, a special authority to reposent tbo iurah fit {peeling ; though, 1 mast ssf, tbe letter cf the fow implies it; aud it would bo pruJeot to cop foi» to its exigency. But to b# each tbe authori*y to any other person to represent ibe cc«iforarion aud vote for it at any meetiug must be oupferred by a resolution of ibe board, unless tbe cfca*j*r or the by-laws of tbe iustuu ion coufer to othets tpe power to nuipe its representativep or agents in in stances such as tbe one nnder considération Several banks teofe iu this case represented by persons bold ng powers pf altorney aliened either by the cashier, manager or president without anything to show their authority to do so.Tbe vote# bo given would have been rejected for that reason if there had been no other.Other very important piovitious of tbe law bearing upon tnls cosomnst b» spa dally noted.Section 32 of this act of 1876 bas been repealed by section 11 of 40 Fic., cap 41, and another substituted in lieu thereof, containing among other prohibitions tbe fol fowing : “No person shall act as tbe attorney oragept pf any creditor upou any question as to the appointment of such person as assignee, or in reference to fioy claim or demanl of sucb creditor on an insolvent estate of which such person ia the assignee.” Mr.Owen Murpby, one of tbe two persons proposed, aud for tbu appointment of whom as .(he creditors were divided, held powers of attorney from ten of the creditors represented them fit the said meeting and voted for bis own appointment as assignee Mr.Murphy is an efficial assiguee and fis such one of tbe officers of the Court ; be is ooe of the public office!* named by His Excellency Upi Governor-General under tbe law to carry it into effect ; Sec.34 of tbe Statu.e last cited enacts that “u.very official assignee shall print aud causo to be pqeted in a conspicuous place in hi* office sections 32” (containing the prohibition which be set at naught,) and 46 of tbe said Insolvent Act of 1876 ae amended and at every meeting of creditors a printed copy of the said sections shall oe laid upon the (able.' This statute^aure infp force on the 28tb of April last and was ahoijly efier published in the Canada OaxtUe.Mr.Murpby cannot therefore plead ignorance io exteuuatioa of bis bold contempt of the law which he was appointed to execute aud his daring violation of the provisions which re gulated his office, for such ignorance would he inexcusable, aud iu a mau in his position as direct and plain a dereliction of the duties be a.'Suracd on accepting office as a wilful violation of the lay.Tula violation of tbe law, wbicb is prohibitory, ffj at common law s mitdenraauour, toy which Mr.Murpby may be indicted ; and finder section 3fi of ttre statute, 40 Vic., cap.«1, above cited, I am obliged to report tbe facta to the Secretary of State for the information of the Governor, j regret exceedingly tbat It has fallen to my lot to make these remarks and the report just mentioned, but I would be myself wantiug in duty if I bad aUoçrad the matter to pass an-noticed, and the law does not permit my witb-hoUifug the report it exacts.Section 29 of the act empowers the eye-ditors at their first meeting, or at any other meeting called for thfit pfffpose, to appoint an assignee, end determines thfit iff default of such appointait-fft the official assigfiw tor main the assignee of the estate; anh section 35 also authorises the creditors at any meet* rag io appoint one or more inspectors wbo snperiuteud and direct tbe proceedings of tbe aà«igat.e iu tbe msuagement and winding up of tbe eeuto.Tbe creditors may at subsequent mettiugs revoke tbe nomination of me assignee and of any U’bpector and appoint others in tbeir place.Un tfip fpsolu-tious proposed for the appointment of an assignee sod ot inspectors, os already mentioned, tbe cieditors did not agree, a number of them suaiainiug and voting for (he motion propostug Ur.Oweu Murpby as assignee, aud a Lumber of others sustaining and voting for tbe motion proposing the appointment ot Mr.Richard Henry Wuttele—two motions were aiso made, ouo for the appointment of Messrs Holt sod Webster as inspectors, aud ano.her proposing Musais W.Ü Wo it* le and Borstall. Both parties objected lo a considerable number of votes on each side and upon each motion, but th» chaiman refused to entertain any of the objections and received and counted all the votes given, even, as it appears by the proceedings, tbat of one creditor who" bad filed no claim.Tboee wbo pretended they had on tbeir side the majority of legal votes, being thereby pnt in tbe minority, were naturally dissatisfied at tbe result and have as above stated, applied to tbe judge to obtain the rescinding tbe resolutions declared carried as they allege, through an illegal majority, and to pnt tbeir nominees in poetession of tbe trust which, as they preteodtd, they hud been ppoiuted by a legal majority.J will bow proceed to review each vote, but after what I have already said my remark nn each will be very concise. For Owen Murphy ns Ataiguee.John
