it seemed as if ho would tlie from strangulation.One of tlie family suggesteil (he use of Ayer\u2019s Cherry Pkond to the Sheriff.He then made a proposition to the city to pay the instalments ot the principal then due with all arrears of taxes and interest, and to give them a mortgage for the balance at six per cent.This proposition was accepted by the Council, who by the resolution in question authorized the Mayor and Secretary to accept the proposal.The petitioners say that this was a loan, and beyond the power of the Corporation to make it; that the City, at the time, was owing moneys to the Eastern Townships Bank and other parties, upon which they were paying seven per cent interest ; and that under these circumstances they ought to have insisted upon payment in cash to be applied on their indebtedness.Two points are raised here: in the first place was this a loan, in the second place, if it was a loan, was it tUtra vires of the corporation.It can hardly be called a loan, as the City had not the monçy ; and if Mowrey did not pay it, their only recourse wag to have the property resold, at his folle-enchtre.The Council had a discretion to exercise in this matter ; they gave delay for a time, getting sixtier cent in place of five per cent payable under the old moitgage.This was not a direct loan, and even if it had been, it is a question whether the petitioners have shown sufficient personal interest to ask to have the resolu- tion set aside.It was a matter in the discretion of the City, and the Court cannot place itself in the position of the Council, to investigate the financial standing of the City.Article 499 of the Municipal Code gives the Council power \u201cto deposit at interest in a chartered hank, or to invest in the public funds of Canada, or of this province, or on first hypothec, any moneys belonging to the cor-poiation,\u201d so that if the transaction can be regarded as a loan, it seems to tall within the provisions of this Article.Two of the petitioners, namely : R D.Morkill, Jr, and H.L.Gilbert are proved not to have been municipal electors ; and J.D Mowrey, Petitioner ; and The Quebec Central Railway Company mis en cause.\u2014This was a petition on behalf of the Plaintiff, Mr.Mowrey, for a writ of possession to order the Sheriff to put him into possession of the property known as the \u201c Meat Factory Property \u201d in East Sherbrooke, bought by the Plaintiff at Sheriff\u2019s sale on the fifteenth day of January last.The petition was contested by the Quebec Central Railway Company who claimed to be holding the property under an annual lease from Boweu k Woodward, terminating on the first day of May each year.That as they had held over since the first day of May 1884, with permission ef the Defendants, they could not be dispossessed until the first day of May 1885.His Honor held that it was unnecessary in this case to go into the question as to whether a Sheriff\u2019s sale entitled the adjudicataire to expel the tenaut without notice, as the Quebec Central Railway-Company had continued their possession up to the expiration of the terra ending the first of May 1884.But that under the circumstances of this case there could be no presumption of the tacit renewal of the lease between Defendants and the Quebec Central Railway Company, inasmuch as the ownership ot the Defendants ceased on the fifteenth day of January last, when the Plaintiff became the adjudicataire, since which date the Plaintiff bad been endeavoring to obtain possession of his property.That the circumstances of this case were altogether against the presumption of the tacit reconduction pleaded by the Quebec Central Railway Company aud the petition must be granted.Writ ordered to issue to dispossess the Defendants and the Quebec Central Railway Company, aud put the Plaintiff into possession.Ives, Brown k French, for Plaintiff ;
