CAUSED BY FIRE! AT DETROIT! THE value of an affidavit in the face of a counter-affidavit, both sworn to by the same individual, Is a matter which is receiving the serious consideration of the court in the case of Nicol vs.Noel, which is now entering upon the third day.Yesterday\u2019s evidence showed that this is what occurred in the case of Victor Benoit, and the witness was put through a gruelling cross-examination by Mr.iSt.Germain, K.C., counsel for the defendant.During the course of the afternoon, a large number of witnesses were heard for the plaintiff, who contented himself with undertaking to establish that rumors that the Hon.Jacob Nicol had become associated with measures for the trafficking of liquor licenses, were current only subsequent to the date on which Dr.J.E.Noel had secured the affidavits from Wilfrid Cote, Ludger Roy and Victor Benoit.It was a posmopolitan array of witnesses who gave evidence during yesterday afternoon\u2019s session.Following closely upon the heels of Mayor Morris, there was an ex-mayor, Conservative and Liberal candidates, an ex-president of the Board of Trade, an alderman, a contractor, notaries galore, newspapermen, a city attorney, a detective,, hotel operators, hotel clerks, and lawyers.Hon.Nicol And His Business Associated Chief Witnesses At Court This Morning Messrs.W.Lazure and J.S.Couture, associates of the Hon.Jacob! Nicol, took the stand early this; morning, and were called upon to explain the amounts of $760 and $200 paid by Benoit and Cote, res-pestively.Mr.Lazure observed that he had little to do with the actual transaction and confined himself to mentioning that thei charges were reasonable.Mr.J.6.Couture detailed the Benoit account.He had been looking after this himself and showed that the : greater portion of the account was; for actions entered against Gagne,; who refused to pay w'hat Benoit claimed was a fair share of the profits.On another occasion Ben-' oit held Gagne was not paying his full proportion of the repairs to the house, and finally an action : was taken to dissolve partnership.Cross-examined by Mr.Aime Geof-?rion, witness declared that the1 account for $760 did not include a single cent for work .of any nature in connection wdth securing of a license, and further that nothing had been charged for any alleged advice given in this connection.La-1 zure stated emphatically that the amount charged was very reasonable, and further that the account had veen very clearly detailed to Mr.Benoit.Cross-questioned by St.Germain for the defence, Lazure failed to give a very satisfactory explanation of the accounting methods.The settlement of Benoit\u2019s account covered consultations extending ever an indefinite period.Mr.Lazure refused to admit that any of the consultations insofar as he was concerned, was associated With licenses and, to his knowledge, Mr.Nicol had not held any.Dr.Ernest Plante heard of certain rumors relative to trafficking in licenses and contended that he heard of same about the time the affidavits were secured by Dr.Noel.Hon.Jacob Nicol took the stand and made a number of corrections of the deposition given at the examination on discovery.Questioned by Mr.Geoffrion, he emphatically denied that ho had ever received a single cent In connection with the granting of licenses.Touching upon transactions with Mr.Benoit relative to tho purchase of property in 1920, he said he was interested because the property was offered at a reasonable price and presented a fine real estate transaction.Geoffrion:\u2014\u201cYou were not interested in politics?\u201d Nicol:\u2014\u201cNo.\u201d Geoffrion:\u2014\u201cYou arc a lawyer, t'ou have been here long?\u201d Nicol:\u2014\u201cSince 1906.\u201d Hon.Nicol admitted being a member for Compton County, member for Richmond County, JProvincial Treasurer, and being connected with the National Bank, Btanstead and Sherbrooke Mutual Fire Insurance Co., and the Sherbrooke Loan and Mortgage Company.Geoffrion:\u2014\u201cThat is all you know about tho Benoit contract \u201d Nicol:\u2014\"Yes.I heard nothing about it for a long time, and on my return from Europe I was surprised to hear I had been spoken of as Treasurer.I simply advised Benoit I would be glad to help him on with the money hut I would have nothing to do with operating any concern.\u201d Mr.Nicol detailed his associations with Benoit, holding that the contract was passed in 1920, prior to his entry in politics.Benoit claimed he was being persecuted, by the chief of police.Hon: Nicol\" said he advised him that while it was preferable to get a recommendation from the council and the chief of police, it was not essential inasmuch as the Liquor Commission was entirely responsible for granting licenses.He was very much surprised on his return from Europe to find that his name had been suggested as Treasurer.He undertook to furnish Benoit with the necessary money, but refused to be associated with'the operation of any hotel.Mr.Nicol commented upon the great possibilities of the legal profession, stating that on one occasion, when he had been away all month, he received, as his share of the returns, an amount three times as largo as his remuneration as Provincial-Treasurer.Judge Globensky:\u2014\u201cHave you ever enlisted your services to se.-cura licenses?\u201d Nicol:-\u2014\u201cNo.My office is continually filled with people from all sections of the province, asking about schools, etc., and as deputy, I must listen to them.\u201d Mr.Nicol stated that he had referred Cote to Hon.Simard for Instructions relative to securing a license.He had done nothing himself.^ .\u2014 - ^ Lionel Forest, K.C., Called.I *-;- Hon.Nicol\u2019s evidence was at this point adjourned to hear that of Mr, Lionel Forest, K.C., who denied that he had ever told Dr.Noel that there were rumors circulating relative to Nicol\u2019s alleged trafficking in licenses.Cross-examined by Mr.Paul St.Germain, K.C., Mr.Nicol admitted that ho had an interview with Mr.Simard and Mr.J.H.Lemay relative to Gagne and Benoit.He said the Interview was not arranged and he stated that insofar as he was concerned he did not care whu was given the license.Mr.St.Germain\u2014\u201cMy information Is that you had been supporting Mr.Benoit\u2019s application.\" Nicol\u2014\u201cAbsolutely not.\u201d With the conclusion of Mr.Nicol\u2019s evidence, the case of the plaintiff was declared closed with the exception of hearing Mr, Arthur Bail-largeon who is sick « Another Important Affidavit In The Nicol-Noel Case The following is the affidavit of Victor Benoit which was produced and discussed in the Nicol-Noel case in the Superior Court yesterday: \u201cAgreement passed between Victor Benoit, hotelkeeper, of Sherbrooke, and Jacob Nicol, lawyer, of Sherbrooke: i4If the said Benoit purchases the rights of Wilfrid Cote in a lease for a hypothecary loan passed August 11th, 1919, for the sum of $4,000, he undertakes to transfer same to the said Nicol for the same amount, and the said Nicol then becomes partner of the said Benoit, as Wilfrid Cote was formerly, and the lease passed in favor of the said Benoit, by Benoit and Cote, will remain in force.The said Benoit will have the right to receive the rent of the lunch cart, which will belong to him.It is understood that when the said Nicol will become Benoit\u2019s partner, both parties will arrange to make repairs to the hotel, and in this caao now arrangements will be made, \u201cDated Sherbrooke .December, 1920.\u201cIi Victor Benoit, undersigned, duly sworn on the Hoiy Bible, declare the above document was dictated by Mr.Nicol himself to his stenographer and that ho handed same to me himself.Mr.Cote did not accept the offer.Since, about February and March, 1922, the Hon.Nicol suggested to me that the only way to get rid of Cote was to have the property sold.\u2018I am to receive $100,000 from a timber limit,\u2019 he said, \u2018in the spring, and 1 will furnish the necessary money to buy the hotel and we will be partners in the hotel.\u2019 Since I rented from Benoit and Cote it has always been the understanding with Mr.Nicol that he would furnish me the money to purchase a partnership with him.\u201c(Signed) V.Benoit.\u201cSworn before me at Sherbrooke, October 16th, 1922.(Signed) Teles-phore Belanger, Commissioner of the Superior Court, District of St.Francis.\u201d Flames Spread Very Rapidly\u2014 Total Loss Is Estimated at a Million and a Half Dollars.(Associated Press Despatch) DETROIT, Nov.28.-\u2014Fire starting from an over-heated stove in a watchman\u2019s shanty early today destroyed the Detroit and Windsor Company Dock, bousing United States immigration and customs offices, spreading to the six storey Hunger building, which was burned to the ground, and then destroyed a four storey warehouse and several small buildings on Woodward Avenue, and Bates street.When the fire was brought under control a few minutes after five o\u2019clock this morning, the total loss was estimated at $1,500,000.fera , P mm HERBERT ASQUITH SHOUTED DOWN AT PAISLEY; BALDWIN TO ATTEMPT TO SPEAK AT GLASGOW TONIGHT Vote of Women Uncertain in Great Britain\u2014Canvasser* Cannot Frame Anything Like a Close Estimate of Result of Polling on December 6\u2014Many Anti-Labor Speakers Are Complaining that They Cannot Get a Hearing, Especially in Constituencies Where Communist Element Is Strong\u2014Mr.Asquith Forced to Give Up Attempt to Address Paisley Meeting.- A'.-.-.- - You must say \u201cCalifornia\u201d or von mav vet an imitation fig syrup.TWO DEAD IN TRAGIC FIREAT ST.JOHNSBURY Father and His Three-Year-Old Daughter Burned to Death\u2014 Another Little Girl Was Saved.ST.JOHNSBURY, Vt., Nov.28.\u2014 Alphonse Guyer and his three-year-old daughter, Dorothy, were victims in a double tragedy on Monday night which occurred when gasoline or kerosene used to light a fire in a stove, exploded, setting their home on fire.The little girl was instantly burned to death by the flames from the burning oil.The father died at the St.Johnsbury Hospital, and another daughter, Genevieve, aged five, was badly burned about the face and one arm.On his way to the hospital tn the ambulance Mr.Guyer was able in a few disjointed words to tell his brother Gustave something of the fearful tragedy.The family had been away from home during the day and his first thought on entering the kitchen was to start a fire, supposing the fire was out he poured what he supposed was kerosene into the stove and was just applying the match when the can which he had placed on the stove explodded.It is supposed that there was fi're in the stove and enough to heat the contents of the can.Mrs.Guyer was at the home of Mr.and Mrs.Albert Eastman, the I house adjoining hers, when the cas-i astrophe occurred.Only conjecture can give the picture of the tragedy, for Mr.Guyer, though able to speak a little when the ambulance arrived, was not conscious long enough to i tell the story of just what happened.Evidently he was carrying the little | girl ./hen he entered the kitchen and j sat her down on a low shelf as he j prepared to start the fire.As the j flaming oil shot from the stove and can it ipread over the child and Mr.Guyer.Mr.and Mrs.Eastman were seated their parlor with Mrs.Guyer when suddenly, what appe^*.ed to be a Hugo torch, flashed past the front of the house and reappeared on the back porch.The door opened and Mr.Guyer, his hair, clothing and arms aflame with the burning oil, rushed into the house.Mr.Eastman snatched up a blanket and succeeded in muffling him in it, but not before he himself was badly burned on both arms and hands.Stanley Fay found the body of the child.He had entered the blazing, smoking room once and returned to the out-of-doors for air.But when someone said \u201cThere\u2019s a baby in j there,\u201d he again went into the smoke-filled kitchen to join Earl Daniels and Theodore Bocash in their search for the child.The fact that she was on the low shelf delayed the finding of her because the firemen naturally were searching about on the floor.The whereabouts of the second little girl, Geneviev» at the time of the explosion of the oil is unknown.She received bums about her face and along one arm, but they were not serious.Site was taken to the homo of a neighbor and kept there during the evening.Stanley\u2019s ambulance carried Mr.Guyer to the St.Johnsbury hospital after first aid had been administered to his burns.At the time he could just speak and little hopes were j held for his recovery.He died at four o'clock next morning.The loss to the house has not been j estimated as ye£, but the flames {spread so rapidly the kitchen, din-jlng room and an upstairs room over | the kitchen were wrecked.The quick and efficient work of the department !
