Whereas, section 12 of this act provides that the Minister may make an allowance to vendors for their services in collecting and forwarding the tax imposed by this act to the Minister, which allowance shall be determined by regulation; Whereas, under subsection 1 of section 19 of this act, the Government may make such regulations, not inconsistent with this act, as are considered necessary for the purpose of carrying into effect the provisions of this act according to their true intent or of supplying any deficiency therein; Whereas, the Regulation respecting the application of the Tobacco Tax Act (R.R.Q., 1981, c.1-2, r.1) was made under this act; Whereas, it is expedient to amend this regulation in order to determine the allowance payable to wholesale vendors who have signed an agreement under section 17 of the Tobacco Tax Act with the Minister of Revenue for collecting and forwarding the tax imposed by this act to the Minister; It is ordered upon the recommendation of the Minister of Revenue; That the Regulation attached hereto entitled: \"Regulation amending the Regulation respecting the application of the Tobacco Tax Act\" be made.Roch Bolduc, Clerk of the Conseil exécutif_ Regulation amending the Regulation respecting the application of the Tobacco Tax Act Tobacco Tax Act (R.S.Q., c.1-2, s.12 and s.19, subsection I) 1.The Regulation respecting the application of the Tobacco Tax Act (R.R.Q., 1981, c.1-2, r.I) is amended, in section 1: (1) by replacing, at the end of paragraph b, the period by a semicolon; (2) by adding the following paragraph: \"(c) \"related persons\": persons who do not deal at arm's length as defined in sections 17 to 21 of the Taxation Act (R.S.Q., c.1-3).\" 2.The Regulation is amended by adding, after section 12.the following sections: \"13.A person holding a registration certificate, who acts as a wholesale vendor and who has concluded an agreement with the Minister under section 17 of the Act obtains, where the agreement so provides, an allowance equivalent to 2 % on the first 1 200 000 $ of tax collected and 0,1 % on the excess.This allowance, though, shall not exceed 100 000 $.The maximum amounts of I 200 000 $ and 100 000 $ are computed on the tax collected and remitted for each fiscal period of the Government and take into account the tax collected and remitted by all the related persons.No allowance is granted in the case of sales between related persons nor where the person acts as a retail vendor.14.A person referred to in section 13 obtains, where security to guarantee the payment of one month of remittance is required by the Minister pursuant to the terms of the agreement, an amount corresponding to the premium paid by that person to obtain the security up to a limit of 4 $ for each 1 000 $ for which security is given.The amount allowed for the premium paid may, upon presenting the receipted invoice, be retained and deducted at the time of filing the monthly report.The amount of security shall be indicated on the invoice.\" 3.This Regulation comes into force on the date of its publication in the Gazette officielle du Québec.3513 2424 GAZETTE OFFICIELLE DU QUÉBEC.September 24.1986.Vol.118.No.41_ Pan 2 Notice of adoption An Act respecting labour standards (R.S.Q.c.N-I.l) The Minister of Manpower and Income Security.Pierre Paradis, hereby gives notice, pursuant to sections 33 ans 92 of the Act respecting labour standards, that the \" Regulation amending the Regulation respecting labour standards \", published in Part 2 of the Gazette officielle du Québec of July 9, 1986.on page 1095 was adopted without amendment under Order in Council 1394-86.appearing here below with the text of the Regulation as adopted.Therefore, this Regulation shall come into force 1 October 1986.Pierre Paradis.Minister of Manpower and Income Security Gouvernement du Québec O.C.1394-86, 10 September 1986 An Act respecting labour standards (R.S.Q., c.N-I.l) Regulation \u2014 Amendments Concerning the Regulation amending the Regulation respecting labour standards Whereas under subsection 1 of section 89 of the Act respecting labour standards (R.S.Q.c.N-I.l).the Government, by regulation, may fix labour standards respecting the minimum wage; (2) the inspection report covered by section 8; (3) the inspection report covered by section 11.3.Permits shall be issued by the Minister and shall indicate: ( 1 ) the name and address of the holder; (2) the number of the permit; (3) the dates on which the permit takes effect and expires; (4) the place of operation covered by the permit; (5) any conditions, restrictions or prohibitions imposed by the Minister under section 55.28 of the Act.4.Permits are valid only for the place of operation mentioned therein.5.The Minister shall renew the permit of a holder who: (1) makes application therefor in accordance with the form in Schedule 1; any interior parts of such equipment coming into contact with a medicine, a medicinal premix or a medicinal food must be capable of inspection.The equipment must be so designed that no residue is left after use.8.The holder of a permit must have a member of the Ordre des technologues des sciences appliquées du Québec or a member of the Ordre des ingénieurs du Québec inspect his equipment to see that it is in accordance with the requirements prescribed by section 7, using the form in Schedule II.9.The holder of a permit shall clean any part of the equipment that came into contact with medicines, medicinal premixes or medicinal foods before reusing the equipment to prepare foods without medicine, or medicinal premixes or medicinal foods containing different medicines from those used in the preceding preparation.10.The holder of a permit must use equipment providing homogeneous distribution of the medicine in a medicinal food with a coefficient of variation of less than 10 %.Evaluation of the coefficient of variation must be carried out on a lot of medicinal foods corresponding to the maximum capacity of the mixer, by taking nine samples of not less than 100 grams each, taken as follows: Percentage of the quantity of medicinal Sample foods taken out of the mixer r\t0 2°\t5 3°\t10 4\"\t25 5°\t50 6°\t75 7°\t90 8°\t95 9°\t100 11.The holder of a permit must have his equipment inspected quarterly starting from the date of issue of his permit, in the form appearing in Schedule 111, by a member of the Ordre des chimistes du Québec, a member of the Ordre des pharmaciens du Québec, or a member of the Ordre des ingénieurs du Québec, to see that it is in accordance with the requirements prescribed by section 10.12.The holder of a permit must use equipment providing a medicinal content in a medicinal food within the limits prescribed by subsection 2 of section 25 of the Regulation respecting the control and regulation of the sale of feeds (SOR 83-593).Canada Gazette 117.Pan II.2813.13.The holder of a permit must take inventory of the medicines, medicinal premixes and medicinal foods in his possession quarterly, starting from the date of issue of his permit.53.Method of preservation 14.The holder of a permit must identify each lot of medicines, medicinal premixes and medicinal foods held by him and must preserve them in a manner that avoids any chemical, biological or physical contamination of the products by keeping them away from sunlight and vermin in a dry.clean place.He must clean the containers and the premises used for storage of medicines, medicinal premixes or medicinal foods before storing different products there.54.Registers and documents 15.The holder of a permit must keep a register of his purchases of the medicinal premixes and medications mentioned in the list covered by section 9 of the Veterinary Surgeons Act (R.S.Q.c.M-8).The register must indicate for each purchase: ( I ) the generic or commercial name of the medicinal premix and the medication, regardless of the form in which it is presented: (2) the quantity of the product purchased and the concentration of medication it contains: (3) the date of purchase and the invoice number; (4) the name and address of the supplier.16.The holder of a permit must keep a register of his inventories of medicines, medicinal premixes and medicinal foods.The register must show under Ihe dale of each inventory made in accordance with section 13: Part 2 GAZETTE OFFICIELLE DU QUÉBEC, September 24.1986.Vol.118.No.41 2429 (1) the generic or commercial name of the medicinal premix and the medicine, regardless of the form in which it is presented; (2) the quantity of the product in inventory and the concentration of medication it contains.17.The holder of a permit must keep a register of his sales of medicines, medicinal premixes and medicinal foods.The register must indicate for each sale: (1) the generic or commercial name of the medicine intended for use in manufacturing medicinal premixes or medicinal foods; (9) furnish a list of the passenger vehicles he intends to use for operation of the licence applied for, stating the make, the year manufactured and the serial number, such list to include at least one automatic transmission vehicle and one manual transmission vehicle; (10) furnish a copy of Ihe service contract between him and any holder of an instructor's licence of a class corresponding to that of the licence applied for; (11) furnish a copy of the title deed or the lease for any classroom and closed-circuit track where he intends to give instruction in driving; (2) continue to satisfy the conditions for obtaining the licence to be renewed with the exception of paragraph 5 of section 3 in the case of the same instructor designated when applying for the licence; Part 2_GAZETTE OFFICIELLE DU QUÉBEC, September 24.1986.Vol.118.No.41 2437 DIVISION VI CONDITIONS ATTACHED TO LICENCES 12.The holder of a driving school licence must operate the school in accordance with the conditions attached to the category and class of his licence.13.The holder of a general licence must display his licence at his principal place of business.The holder of a temporary licence must display it in the classroom designated in the licence.14.The holder of a Class 1 driving school licence must see that the licence number and the business name of the driving school are legibly shown on both sides of any passenger vehicle.15.The holder of a driving school licence must see that the licenced instructor-monitor or licenced instructor is present in the classroom for the entire duration of a theoretical lesson defined in Schedule V.16.The holder of a Class 1 driving school licence must see that only one student at a time is present in a passenger vehicle during each practical lesson defined in Schedule V.17.The holder of a Class 2 driving school licence must have a closed-circuit track for practical lessons in driving a motorcycle.The holder must see that the closed-circuit track: ( I ) has an area of at least 13 500 m2; (2) has a surface of asphalt, concrete or beaten earth.18.The holder of a Class 2 driving school licence must see that the equipment described in Schedule II is available for use and is used during practical lessons in accordance with the program described in Part B of Schedule V.19.Where the holder of a Class 2 driving school licence uses a closed-circuit track located on a public road, he must receive the agreement in writing of a municipal corporation or the Government of Québec, and see that the ends of the part used by the school are blocked so that the track is inacessible to any passenger vehicle other than a motorcycle.Where he uses a closed-circuit track located on a public or private parking lot, he must see that the closed-circuit track is inaccessible to any passenger vehicle other than a motorcycle, and that it is marked by clearly visible physical obstacles preventing any passenger vehicle from entering.Where he uses a closed-circuit track located on an abandoned road, he must see that the ends of the part of the road used by the school are permanently blocked.20.The holder of a Class 2 driving school licence must see that a licenced instructor giving practical lessons on a closed-circuit track does not give instruction to more than five students at a time, each having a motorcycle.He must also see that, during a practical lesson on a public road, the licenced instructor rides a motorcycle and does not give instruction to more than three students at a time, each having a motorcycle.21.The holder of a Class 2 driving school licence must see that, during practical lessons with motorcycles on a public road, the licenced instructor and the students wear the vest described in Schedule III.22.The holder of a driving school licence must see that a student record drawn up in the form shown in Schedule IV is completed for each student and is given to the student at the end of the course.23.The holder of a driving school licence must inform the Régie of any change or alteration occuring since the last application for the issue or renewal of his licence in respect of a condition he must satisfy, or a document or information he must produce.DIVISION VII TRANSFER OF LICENCES 24.A driving school licence may be transferred on application in writing by the holder to the Régie and where the recipient satisfies the prerequisites prescribed by Division II.CHAPTER U INSTRUCTION LICENCES DIVISION I CATEGORIES AND CLASSES OF INSTRUCTION LICENCES 25.There shall be the following categories of instruction licences: (1) an instructor-monitor's licence; (2) Class 2, authorizing the holder to give instruction in driving a motorcycle.27.A licenced instructor-monitor may give theoretical and practical instruction covered by his class of licence.28.A licenced monitor may give practical instruction covered by his class of licence.29.A licenced instructor may give theoretical instruction covered by his class of licence.DIVISION II INSTRUCTOR-MONITOR'S LICENCES 30.An applicant for an instructor-monitor's licence must: (1) hold a driver's licence issued by the Régie of the class corresponding to the class of licence applied for; (2) have held for not less than three years a driver's licence permitting the driving of a passenger vehicle corresponding to the class of licence applied for; (3) have held for not less than two years a monitor's licence of the class corresponding to that applied for, expiring not more than three months before the date of the application; (4) have given not less than two thousand hours of training in the driving of a passenger vehicle other than a motorcycle, or four hundred hours in the driving a motorcycle; (5) have completed an instructor's vocational instruction programme recognized by the ministère de l'Enseignement supérieur et de la Science under the General and Vocational Colleges Act (R.S.Q., c.C-29).31.An instructor-monitor's licence is valid for two years, and expires at the same time as the holder's driver's licence.Where the licence has less than 3 months to run, it must be extended for 24 months.DIVISION III MONITOR'S LICENCES 32.An applicant for a monitor's licence must: (I) hold a driver's licence issued by the Régie of the class corresponding to the class of licence applied for; (2) have held for not less than three years a driver's licence permitting Ihe driving of a passenger vehicle corresponding to the class of licence applied for; (3) hold a secondary school certificate or an equivalent recognized by the ministère de l'Education under the Act respecting the Conseil supérieur de l'Éducation (R.S.Q., c.C-60); (4) have completed a vocational instruction programme recognized by the ministère de l'Enseignement supérieur et de la Science under the General and Vocational Colleges Act.relating to instruction in driving a passenger vehicle of the class corresponding to the class of licence applied for.33.A monitor's licence is valid for two years and expires at the same time as the holder's driver's licence.Where the licence has less than 3 months to run, it must be extended for 24 months.DIVISION IV INSTRUCTOR'S LICENCES 34.An applicant for an instructor's licence must satisfy the conditions in section 30.The applicant is not required to hold a driver's licence where the issue or renewal of such licence has been refused, or where his driver's licence has been suspended, in either case for medical reasons.35.An instructor's licence is valid for two years and expires al Ihe same time as the holder's driver's licence.Where the licence has less than 3 months to run.it must be extended for 24 months.DIVISION V RENEWAL OF INSTRUCTION LICENCES 36.Instruction licences may be renewed on the date of their expiry on the same conditions as those on which they were obtained.DIVISION VI CONTENTS AND CONDITIONS OF INSTRUCTION LICENCES 37.An instruction licence must contain the following particulars: (1) Ihe category, class and number; (5) a print of a colour photograph of Ihe holder taken by the Régie.38.The holder of an instruction licence must wear the licence on his person so that it may be seen by the students when he gives instruction.39.The holder of a Class I instruction licence must see.when he is giving practical lessons to a student, that no other student is present in the passenger vehicle.40.The holder of a Class 2 instruction licence giving practical lessons on a closed-circuit track may not give instruction to more than five students at a time, each having a motorcycle.In practical lessons on a public road, the holder of a Class 2 instruction licence must ride a motorcycle and may not give instruction to more than three students at a time, each having a motorcycle.41.The holder of a Class 2 instruction licence must wear the vest described in Schedule III during practical lessons with motorcycles on a public road.He must see that the students also wear such a vest.CHAPTER III INSTRUCTION 42.The holder of a driving school licence must give his courses in accordance with the program set forth in Schedule V.43.The holder of a driving school licence must see that Ihe number of students per classroom does not exceed 40.CHAPTER IV PASSENGER VEHICLES 44.The holder of a Class 2 driving school licence must see that the motorcycle he uses for practical lessons has a motor of cubic capacity not less than 100 cm' and not more than 250 cm'.45.The holder of a Class I driving school licence must see that the passenger vehicle he uses for practical lessons is equipped with: (1) dual brake pedals; (2) dual clutch pedals, if the vehicle has manual transmission; (3) two inside rearview mirrors attached to the windshield or ils frame and two outside side rearview mirrors.46.The holder of a Class I driving school licence must see during a practical lesson that the passenger vehicle is equipped with a sign on the roof, visible both from in front and from behind and bearing only the words \" élève au volant \" or \" auto-école \".The words must be legible at a distance of not less than 30 metres.47.The holder of a Class I driving school licence who uses a vehicle adapted to a handicapped person to give him instruction must see that the vehicle has been subjected to a mechanical inspection and thai it meets the standards prescribed in sections 45 and 46.CHAPTER V OFFENCES 48.Any infringement of sections 12 to 23.38 to 41 and 42 lo 47 constitutes an offence.CHAPTER VI FINAL AND TRANSITIONAL 49.Paragraph 8 of section 3 does not apply to a person who works for a secondary or post-secondary school and who was the holder of a driving school permit before 16 October 1985.50.A driving school permit issued under the Regulation respecting driving schools (R.R.Q.1981.c.C-24.r.13) remains in force until the date of its expiry, and may be renewed in accordance with this Regulation.Until 30 June 1987.the holder of a driving school general licence issued under the Regulation is not subject to the condition in paragraph 5 of section 3 for the renewal of a licence.51.A monitor's permit issued under the Regulation respecting driving schools (R.R.Q.1981.c.C-24, r.13) remains in force until the date of its expiry, and may be renewed in accordance with this Regulation.A pleasure vehicle monitor's permit, a motorcycle monitor's permit and a pleasure vehicle-motorcycle monitor's permit respectively become, effective from (insert the date of the coming into force of this Regulation), a Class I monitor's licence, a Class 2 monitor's licence and a Class I and Class 2 monitor's licence.52.An instructor's permit issued under the Regulation respecting driving schools (R.R.Q.1981.c.C-24.r.13) becomes a Class I monitor-instructor's licence and may be renewed upon expiry in accordance with this Regulation. 2440 GAZETTE OFFICIELLE DU QUÉBEC.September 24.1986.Vol.118.No.41 Part 2 53.For the purposes of paragraph 3 of section 3 and for 3 years following the (insert the date of coming into force of this Regulation), the holder of an instructor's licence or a Class 2 monitor-instructor's licence may be designated in the application for the licence even where he has not held such licence for three years.54.This Regulation replaces the Regulation respecting driving schools (R.R.Q.1981.c.C-24.r.13).55.After its adoption by the Government this Regulation will come into force on the 15'\" day following the date of its publication in the Gazette officielle du Québec of its final text on any later date fixed in it.
