(Revised Statutes of Quebec 1941, chapter 163 and amendments), the contracting parties hereafter mentioned have submitted to the Minister of Labour a petition for the purpose of rendering obligatory the collective labour agreement entered into between: On the one part: \"L'Association des Photographes Professionnels de la Province de Québec (Section des Cantons de l'Est) Inc.\"; And, on the other part: \"L'Association des Employés en Photographie des Cantons de l'Est\", for the employers and employees of the trade concerned, according to the conditions described in the Quebec Official Gazette, issue of June 2, 1956; Whereas the provisions of the said petition have acquired a preponderant significance and QUEBEC OFFICIAL GAZETTE, Quebec, April Cth, 1957, Vol 89, No.1A 1299 prépondérantes pour l'établissement des conditions de travail dans le métier visé et dans la juridiction territoriale indiquée dans ladite requête; Attendu que les dispositions de la Loi ont été dûment suivies en ce mots et les termes suivants sont la signification qui leur est ci-après donnée: a) Photographie professionnelle: La photographie professionnelle est l'art, la profession ou l'occupation de celui qui: 1° à l'aide d'accessoires photographiques tel que: caméras, agrandisseurs, imprimeuses, etc.peut produire, au moyen de substances sensibles à l'action de la lumière, des images de personnes, d'animaux ou de choses; 2° à l'aide de l'action de la lumière et de l'action des produits chimiques, peut transférer d'un matériel devenu insensible à un matériel sensibilisé, ces images appelées négatifs ou positifs selon le cas; 3° à l'aide de l'action des produits chimiques, peut rendre ces images latentes visibles et permanentes.Ceci ne doit pas inclure la cinematographic, le procédé appelé \"Blue printing\", la photogravure, le photostat, les rayons X et tous autres procédés semblables.b) Photographe professionnel: Le photographe professionnel est celui qui, pour fins de rémunération, exerce l'art, la profession, ou l'occupation de la photographie professionnelle, et qui a obtenu du bureau des examinateurs du Comité paritaire, un certificat le qualifiant photographe professionnel.c) Photofinisseur: Le photofinisseur est celui qui, dans la profession ci-haut décrite, a complété son temps d'apprentissage, mais qui ne possède pas toutes les qualifications nécessaires pour obtenir le certificat le qualifiant photographe professionnel.d) Atelier: L'atelier est l'endroit où le photographe professionnel ou le photofinisseur exerce son art, sa profession ou son occupation et l'endroit où se fait l'apprentissage.e) Studio: Le studio est l'endroit ou le salon, où, à l'aide de sa caméra, le photographe professionnel exerce son art, sa profession ou son occupation, en étant au service de son client./) Laboratoire: Le laboratoire est l'endroit communément appelé chambre noire, où le photofinisseur et le photographe professionnel font le développement, l'impression et l'agrandissement des photographies.g) Photo: Le mot \"photo\" désigne la reproduction des images de personnes, d'animaux ou de choses au moyen de procédés photographiques.h) Portrait: Le mot \"portrait\" désigne une photo de personne prise dans un studio de photographie, et reproduite au moyen de procédés photographiques.i) Artisan: Le mot \"artisan\" désigne toute Personne qui pratique le métier de photographe, seule et pour son propre bénéfice.importance for the establishing of working conditions in the trade concerned and in the territorial jurisdiction indicated in the sail petition; Whereas the provisions of the Act were duly observed as regards the publication of notices; Whereas the objections set forth were duly considered, as required by the Act; It is ordered, therefore, on the recommendation of the Honourable the M inistcr of Labour: That the said petition be accepted in conformity with the provisions of the Collective Agreement Act (Revised Statutes of Quebec 1941, chapter 1G3 and amendments) with however the following new provisions to be substituted for the conditions describe 1 in the Quebec Official Gazette, issue of June 2, 1956.I.Definitions: In the decree, the following terms shall have the meaning hereafter given to them : a) Professional photography: Professional photography is the art, profession or occupation of a person who: 1° With photographic accessories such ass cameras, enlargcrs, printers, etc., and by means of substances sensitive to light, can make pictures of persons, animals or things; 2° Through the actio of light and of chemical products, can transfer from a material which has become insensition to a sensitized material, pictures called negatives or positives, as the case may be; 3° Through the action of chemical products, may render visible and permanent such latent images.The term shall not include cinematography, the blue printing process, photogravure, photostat work, X rays and any other similar process.b) Professional photographer: The professional photographer is one who, in consideration of payment, practices the art, profession or occupation of professional photography and who has been certificated by the Hoard of Examiners of the Parity Committee as professional photographer.cy Photofinùher: The photofinishcr is one who, in the above mentioned profession, has completed his apprentisechip period but is not competent enough to be certificated as professional photographer.d) Shop: The shop is the place where the professional photographer or photofinishcr practices his art, profession or occupation and the place where apprenticeship is served.e) Studio: The studio is the place or parlour where the professional photographer practices his art, profession or occupation with his camera by offering his services to his customers./) Laboratory: The laboratory is the place commonly called \"dark room\" where the photo-finisher or professional photographer devcloos, prints and enlarges pictures.g) Photograph, photo, picture: These words mean a picture made by the fixing of images of persons, animals or things by means of photographic processes.h) Portrait: This word means a picture of a person taken in a photographic studio and by means of photographic processes.i) Artisan: The won! \"artisan\" means any person who practices the photographer's trade alone and for his own photos et de négatifs.m) Apprenti: Le mot \"apprenti\" désigne toute personne qui apprend le métier de photographe professionnel, tel que défini au paragraphe b\" du présent article.n) EmployS régulier: IjC terme \"employé régulier\" désigne tout salarié qui fait la semaine régulière de travail de l'établissement où il est employé ou pas moins de (30) trente heures de travail par semaine.o) Employé à temps partiel: Le terme \"employé à temps partiel\" désigne tout salarié qui, embauché de façon intermittente, travaille moins de trente (30) heures par semaine ou de cinq (5) heures par jour.IL Juridiction professionnelle: La juridiction professionnelle de ce décret comprend tous les photographes et photofinisseurs, employeurs et salariés des deux sexes, qui exécutent des travaux de photographie professionnelle et toutes opérations qui s'y rapportent.Le présent décret ne s'applique pas aux personnes qui font de la photographie devant servir exclusivement aux journaux et à des fins d'ordre privé et non commerciales.III.Juridiction territoriale: La juridiction territoriale du décret comprend les districts électoraux de Drummond, Frontenac, Mégantic, Wolfe, Sherbrooke, Richmond, Sheiford, Compton, Brome, Stanstead, Saint-Hyacinthe, Bagot, Ron ville et Arthabaska.IV.Aux fins d'application du décret, les apprentis et les salariés sont classifies de la façon suivante: Apprenti, 1ère année: Son travail comprend: aide de laboratoire, entretien, messagerie et comptoir.Apprenti, Sème année: La qualification de 1ère année et en plus il doit approfondir la technique de laboratoire pour le rendre apte à rencontrer les exigences aussi bien du fini artistique, commercial ou amateur.Apprenti, Sème année: Les qualifications de 1ère et 2ème années; en plus est préposé à tout travail de photographie excepté la pose commerciale ou artistique.Photofinisseur: lies qualifications de 1ère, 2ème et 3ème années en plus est préposé à tout travail de photographie commerciale, plus le droit d'administrer un atelier ou l'on s'occupe exclusivement du travail de chambre noire.Photographe professionnel: Qualification du photofinisseur et en plus peut faire tout travail de photographie artistique et commerciale, plus le droit d'administrer ou d'opérer un studio à son compte ou pour le compte d'un autre.Pour obtenir cette qualification il doit avoir fait un stage d'au moins six (6) mois dans un studio reconnu.\" V.Salaire minima: Les salaires minima sont les suivants: j) Retoucher: The word \"retoucher\" means any person who corrects faults or defects on photographies, negatives or positives.k) Colorer: The word \"colorer\" means any person who applies color on photographies, negatives or positives.I) Clerk: The word \"clerk\" means any person whose work is concerned with the reception, sale, delivery of merchandise and photographies, supervision, telephone, cash, drying and classification of pictures and negatives.m) Apprentice: The word \"apprentice\" means any person who learns the professional photographer's trade, as described in subsection \"b\" of the present section.n) Regular employee: The words \"regular employee\" mean any employee who works the standard work week of the establishment where he is employed, or not less than thirty (30) hours per week.6) Part-time employee: The words \"part-time employee\" mean any employee who is employed intermittently and works less than thirty (30) hours per week or five (5) hours per day.II.Jurisdiction: a) Professional jurisdiction: The professional jurisdiction of the present decree extends to all male or female photographers and photofinishers, employers and employees, engaged in professional photography and all operations connected therewith.The present decree shall not apply to persons doing photographic work to be used exclusively by newspapers or for private non commercial purposes.III.Territorial jurisdiction: The territorial jurisdiction of the decree comprises the electoral districts of Drummond, Frontenac, Mégantic, Wolfe, Sherbrooke, Richmond, Sheiford, Compton, Brome, Stanstead, St.Hyacinthe, Raged, Rouvillc and Arthabaska.IV.For the purposes of enforcement of the decree, apprentices and employees shall be classified as follows: 1st year apprentices: Their work includes laboratory assistance, maintenance, messenger's and counter work.2nd year apprentice: The qualification of 1st year apprentices and further knowledge of laboratory technique in order to comply with the requirements of an artistic, commercial or amateur finish.3rd year apprentice: The qualifications of 1st and 2nd year apprentices; also the execution of any photographic work excepting commercial or artistic pictures.Photofinisher: The qualifications of 1st, 2nd and 3rd year apprentices and the execution of any commercial photography work including the right to operate a shop engaged exclusively in dark room work.Professional photographers: The qualification of photofinishers including any artistic and commercial photography and the right to manage or operate a shop on their own or somebody else's account.To obtain such qualification, he must have served a minimum of six (6) months in a recognized studio.\" V.Minimum wages: The following shall be the minimum wage rates: Commis: 1ère année.2ème année par heure Clerk: .% 0.46 1st year.0.55 2nd year Per pouces.0.75 négat if de groupe.1.00 Coloriage: 5x7.0.50 8x10.1.00 11x14.1.50 10x20.3.00 Aucun travail à la pièce n'est autorisé à l'atelier.VIL Frais de déplacement: a) Pour l'employé régulier, les frais de déplacement doivent tous être payés par l'employeur.b) Pour l'employé à temps partiel, les frais de déplacement dans un rayon de deux (2) milles sont à la charge du salarié, mais au-delà de deux (2) milles, ils doivent être remboursés par l'employeur à raison de 80.10 du mille.VIII.Commission: a) Le photographe régulier doit recevoir en plus une commission de 10% sur les ventes payées qu'il a faites à l'extérieur de l'atelier.b) Le photographe à temps partiel qui pose à l'extérieur du studio doit recevoir 80.50 par pose utilisée; le matériel et l'équipement est fourni par l'employeur.Il doit recevoir de plus une commission de 10% sur les ventes payées qu'il a faites à l'extérieur de l'atelier.IX.Dispositions générales: a) Il est permis aux employeurs d'embaucher (les employés à temps partiel pour faire la retouche et le coloriage à condition que ces travaux soient faits en dehors de l'atelier.b) II est permis aux employeurs d'embaucher au maximum deux (2) employés à temps partiel pour photographier en dehors du studio les mariages, les réceptions, etc., pourvu que ces employés possèdent au moins leur certificat de qualification d'apprenti de 3ème année.c) Un employé régulier n'a le privilège de travailler que pour un même employeur, il n'a pas le privilège d'être employé à temps régulier pour un employeur et à temps partiel pour un autre employeur.X.Durée du travail: a) La semaine normale de travail est de quarante-six (40) heures pour toutes les catégories de salariés.b) Les boires de travail faites en plus de quarante-six (46) heures par semaine doivent être payées temps et demi, que ce travail soit fait le dimanche, les jours de fête ou sur semaine.c) Tous salariés dont les services sont requis pour moins de quarante-six (-16) heures durant une même semaine doivent recevoir une rémunération basée sur les taux hebdomadaires en regard de la semaine normale de travail.d) Lorsque la célébration du Premier jour de l'An, de l'Epiphanie, de made outside the shop.b) Part-time photographers taking pictures outside the studio shall receive $0.50 per picture used, material and equipment to be supplied by the employer.He shall also receive a 10% commission on sales paid and made outside the shop.IX.General provisions: a) Employee may employ part-time employees for retouching and coloring work providing such work be done outside the shop.6) Employers may employ but two part-time employees to take pictures outside at weddings, receptions, etc., providing such employees hold the thirds year competency card.c) Regular employees shall work for one employer only and shall not be permitted to work regularly for an employer and on a part-time basis for another employer.X.Duration of work: a) The standard work week consists of 46 hours for all categories of employees.b) Hours worked in excess of 46 hours per week shall be paid time and one half, whether the work be done on Sunday, on holidays or on week days.c) All employees whose services are required for less than 46 hours during a same week shall receive a remuneration based on the weekly rate computed on the standard work week.d) When the celebration of New Year's Day, Epiphany Day, Ascension Day, All Saints Day, Immaculate Conception Day, Christmas Day, St.John the Baptist Day, July 1 (Confederation) and Labour Day occurs on a working day, the number of hours apprenti de chacune «les qualifications 1ère, 2ème et 3ème années ne peuvent être employés par un même photographe professionnel ou photofinisseur.c) L'employeur doit faire travailler graduellement son apprenti sur les différentes opérations du métier afin d'en faire un ouvrier qualifié.d) L'apprentissage comporte trois (3) années de travail du métier sous la surveillance d'un photographe professionnel.L'année de travail pour fins d'apprentissage «loit comprendre au moins dix (10) mois de travail.Touterois.le temps consacré à l'étude (fans une école reconnue par le Comité paritaire et couronnée par l'obtention d'un diplôme doit être crédité au compte de l'apprenti.e) Après chaque année d'apprentissage, l'apprenti doit se présenter au Bureau des Examinateurs du Comité paritaire pour subir ses examens dans le but d'obtenir son degré d'apprentissage.Au cas d'insuccès, le candidat a droit de reprise d'examen par intervalles de six (0) mois./) Dans l'intérêt de la profession, le Comité paritaire peut reconnaître une école de photographie.Toutefois, aucune école de photographie ne peut fonctionner conjointement, de pair ou de concert avec un studio de photographie.g) Aucun employeur ou autre personne ne peut prendre ou parler un apprenti à son emploi dans la juridiction territoriale du décret, si préalablement, il n'a pas passé un contrat d'apprentissage avec celui-ci, ses parents ou tuteurs par devant le Comité paritaire.h) Pour contrôler la durée de l'apprentissage et le transfert de l'apprenti d'une entreprise à l'autre, l'employeur doit inscrire dans un carnet ad hoc la date d'entrée et de sortie de son apprenti.t) Aucune personne ne peut obtenir son certificat de qualification comme photographe professionnel, sans avoir au préalable satisfait au présent règlement d'apprentissage.Dans chaque atelier ou studio de photographie, propriété d'une compagnie, d'une association, d'une corporation ou d'une personne qui pratique ou non la photographie professionnelle, il doit y avoir un photographe professionnel, employeur ou salarié, porteur d'un certificat de qualification de photographe professionnel, ce dernier ne devant être attitré qu'à un seul studio.j) Au cas où un employeur veut discontinuer de donner de l'emploi à un apprenti qui a été plus de huit (8) jours à son service, il doit en donner avis au Comité paritaire.reduced by the number of hours of a standard work day but the weekly pay shall not he reduced.When so required by the employer, employees shall work on holidays and be paid at the rate of time and one half for all hours worked.Time and one half rates shall be computed on the basis of the weekly wages paid for the standard work week.Should the date of celebration of St.John the Baptist Day and Confederation Day be changed by municipal or other authorities on account of special circumstances, such holidays shall be observed on the day proclaimed by said authorities.XI.Apprenticeship: a) Xo apprentice shall begin his apprenticeship before sixteen (10) years of age.He must bave a ninth-year certificate or the equivalent thereof.b) There shall not be more than one 1st year, one 2nd year and one 3rd year apprentices in the employ of a professional photographer or photofinisher.c) Employers shall make their apprentices work on the various operations of the trade so that they may become skilled workers.d) Apprenticeship consists of three (3) years of trade work under the direction of a professional photographer.A year of work, for apprenticeship purposes, shall include a minimum of 10 months of work.However, time spent as students in a school recognized by tin-Parity Committee and terminated by the obtaining of a diploma shall be credited to the apprentice.e) After each year of apprenticeship, apprentices shall sit before the Board of Examiners of the Parity Committee for their examinations in order to be promoted.In the event of failure, the candidate may sit for another examination after each period of six (0) months./) In the interest of the profession, the Parity Committee may recognize a school of photography.However, no school of photography may be operated jointly or together with a photographer's studio.g) No employer or other person may hire or have an apprentice in his employ, within the territorial jurisdiction of the decree, without first entering into an apprenticeship contract with the said apprentice, his parents or tutors, witnessed by the Parity Committee.k) In order to control the duration of apprenticeship and the transfer of apprentices from one concern to another, employers shall register in a booklet the date of employment and of discharge of their apprentices.i) No one may obtain bis certificate of competency as professional photographer without first complying with the present apprenticeship by-law.In every photographer's shop or studio owned by a company, an association, a corporation or a person who practices professional photography or not, there shall be a professional photographer (employer or employee) holder of a certificate of competency as professional photographer, the latter working for one studio only.j) In the event where an employer wishes to discharge an apprentice who has been more than eight (8) days in his service, he shall notify the Parity Committee to that effect. QUEBEC OFFICIAL GAZETTE, Quebec, Avril 6th, 1957, Vol.89, No.IL 1303 XII.Vacances payées: Tout employeur assujetti au décret doit donner chaque année des vacances payées de six (6) jours- ouvrables à tout salarié qui a un (1) an et plus de service.La rémunération pour cette semaine de vacances est de 2% du salaire gagné depuis la dernière vacance.Une deuxième semaine de vacances doit être accordée aux salariés qui ont cinq (5) ans et plus de services continus pour le même employeur et les deux (2) semaines de ces salariés doivent être rémunérées à raison de 4% du salaire gagné depuis la dernière vacance.Le paiement «le ces vacances doit être remis aux ayants droits avant le début desdites vacances.Le salarié qui laisse le service «le l'employeur ou est congédié, a droit, à titre de rémunération de vacances, à 2% du salaire gagné depuis les dernières vacances.XIII.Durée du décret: Le «lécret est valable le jour de sa publication dans la Gazette officielle de Québec et demeure en vigueur jusqu'au 1er juin 1957.Il se renouvelle automatiquement «l'année en année, par la suite, à moins que l'une des parties contractantes ne donne à l'autre partie un avis écrit à ce contraire, dans' un délai qui ne doit pas être de plus de soixante (00) ni de moins de trente (30) jours avant le 1er juin de l'année 1957 ou de toute année subséquente.Un tel avis doit également être adressé au Ministre du Travail.L.DÉSILETS, 44628-0 Greffier du Conseil Exécutif.Département du Travail AVIS DE MODIFICATION L'honorable Antonio Barrette, Ministre du Travail, donne avis par les présentes, conformément aux dispositions de la Loi de la convention collective (S.R.Q., 1941, chapitre 103 et amendements), que les parties contractantes à la convention collective de travail relative à l'industrie de la réfrigération, rendue obligatoire par la section \"F\" du décret numéro 1121 du 19 octobre 1955, relatif à l'industrie et aux métiers de la construction dans la région de Montréal, lui ont présenté une requête à l'effet de soumettre à l'appréciation et à la décision du Lieutenant-Gouverneur en Conseil une nouvelle section \"F\" dont le texte suit: \"Section \"F\" Dispositions particulières concernant les installations de réfrigération I.Juridiction professionnelle; Cette section régit les travaux d'installation de réfrigération industrielle, commerciale et domestique exécutés dans la juridiction territoriale ci-haut mentionnée, y compris les appareils à l'ammoniaque, au fréon, au méthyle au soufre et autres.IL Apprentis et apprentissage; La période d'apprentissage dans l'industrie est de quatre (4) ans, conformément aux dispositions de la Loi des mécaniciens en tuyauterie de la Province de Québec (Statuts refondus de Québec, 1941, chapitre 173 et amendements).Mécanicien Junior; Le terme \"mécanicien junior\" désigne tout salarié qui s'est qualifié comme mécanicien en vertu de la Loi des mécani- XII.Vacation with pay: Employers governed by the decree shall give, each year, a vacation with pay comprising six working days to every employee who has one year of service or more.The remuneration for this vacation week shall be 2% of the wages earned since the last vacation.A second week of vacation shall be granted to employees with five or more years of service for the same employer and the two weeks vacation shall be paid at the rate of 4% of the wages earned since the last vacation.Vacation pay shall be given before the vacation.Employees who leave their employer or who are discharged are entitled to a vacation pay equal to 2% of their wages earned since the last vacation.XIII.Duration of the decree: The «lecree comes into force on the day of its publication in the Quebec Official Gazette and remains in force until June 1st.1957.It then renews itself automatically from year to year unless one of the contracting parties notifies the other party to the contrary, within the period extending from the 00th to the 30th day before June 1st of the year 1957 or of any subsequent year.Such a notice shall also be filed with the Minister of Labour.L.DÉSILETS, 44028-o Clerk of the Executive Council.Department of Labour NOTICE OF AMENDMENT The Honourable Antonio Barrette, Minister of Labour, hereby gives notice, pursuant to the provisions of the Collective Agreement Act (R.S.Q.1941), chapter 103 and amendments, that the contracting parties to the collective labour agreement relating to the refrigeration industry, rendered obligatory by part \"F\" of the decree No.1121 of October 19, 1955, relating to the construction industry and trades in the region of Montreal, have petitioned him to submit to the consideration and decision of the Lieutenant-Governor in Council a new part \"F\" as follows: \"Part \"F\" Special provisions concerning refrigeration installations I.Professional Jurisdiction: This part shall apply to all industrial, commercial and domestic refrigeration installations executed within the territorial jurisdiction herein before specified, including ammonia and freon, methyl, sulphur, etc., operations.II.Apprentices and apprenticeship: The period of apprenticeship in the industry shall be one of four (4) years, as set forth in the Pipe Mechanics Act of the Province of Quebec (Revised Statutes of Quebec 1941, chapter 173 and amendments).Junior Mechanics: A \"junior mechanic\" shall be a workman who has qualified as a mechanic under the Pipe Mechanics Act (Revised Statutes 1304 GAZETTE OFFICIELLE DE QUÉBEC, Québec, 6 avril 1957, Tome 89, N° l/f ciens en tuyauterie (Statuts refondus de Québec 1941, chapitre 173 et amendements), il doit servir comme mécanicien junior pendant une période d'une (1) année.Compagnon Mécanicien; Le terme \"compagnon mécanicien\" désigne tout salarié qui a été employé pendant au moins cinq (5) ans, conformément aux dispositions de la Loi des mécaniciens en tuyauterie (Statuts refondus de Québec, 1941, chapitre 173 et amendements) et, est détenteur de la licence nécessaire.III.Durée régulière du travail; La durée régulière du travail est de huit (
