2.The name of the ownor of each se]urate lot or parcel of land or of any estate therein, so far as it can be ascertained ; and 3.Everything necessary to the right understanding of such plan.Each separate lot or parcel of land, shewn on the nlan, shall be referred to in the said book, by a number which shall be marked upon the plan and entered in the book.The Commissioner may adopt any means he thinks proper to ensure the correctness thereof.- Each plan and book of reference shall be made up to some precise date, up to which it shall be corrected as far as possible ; et; toute partie de ce lot est suffisamment désigné en décimant qu'elle fait partie de ce lot et eu iiuli- J quant à qui elle appartient, avec ses tenants et aboutissants ; et tout terrain composé de parties de plus d'un lot numéroté est suffisamment désigné en déclarant qu'il est ainsi composé et eu indiquant quelle partie de chaque lot numéroté il contient.\" La description d'un immeuble dans l'avis d'une demande en ratification de titre, ou dans l'avis d'une vente par le shérif, ou par licitation forcée, ou de toute autre vente ayant Its effets du décret, ou dans telle vente ou jugement de ratification, ne sera censée suffisante que si elle est faite conformément aux prescriptions du présent article.\" Aussitôt après que le dépôt du tel plan ut livre de renvoi a été fait et qu'il en a été donné avis, les notaires sont tenus, en rédigeant les actes concernant 1rs immeubles indiques sur tel plan, de désigner ces immeubles par lu numéro qui leur est donné sur lu plan ut dans le livre de renvoi, de la manière prescrite ci-dessus ; à défaut de telle désignation, l'enregistrement ne peut affecter le lot en question, à moins qu'il ne soit produit une réquisition ou avis indiquant le numéro sur le plan et livre de renvoi comme étant celui du lot qu'on veut affecter par tel enregistrement.\" 216*.).Le dépôt des plan et livre de renvoi primitifs dans une circonscription d'enregistrement est annoncé par proclamation du gouverneur en conseil, fixant en même temps le jour auquel les dispositions de l'article 2168 y deviendront en force.'* 2170.A compter de ce dépôt, le résjistrateur doit préparer l'index mentionné en second liou dans l'article 2161.\" 2171.A compter de l'époque fixée dans telle proclamation, lu régistrateur doit faire l'index des immeubles et le continuer jour par jour en iuscri vaut sous chaque numéro de lot indiqué séparément au plan et au livre de renvoi, un renvoi à chaque entrée faite subséquemmeut dans les autres livres et registres affectant tel lot, de manière à mettre toute personne en état de constater facilement toutes les entrées faites subséquemmeut concernant ce lot.\" 2172.Dans les deux ans qui suivent la date fixée par la proclamation du lieutenant-gouverneur, pour la mise un vigueur dus dispositions de l'article 2168, dans une division d'enregistrement, l'enregistrement de tout droit réel sur un lot do terre compris dans cette division, y doit être renouvelé au moyen de la transcription, dans le livre tenu à cet effet, d'un avis désignant l'immeuble affecté, en la manière prescrite en l'article 2168, etobseivant les autres formalités prescrites en l'article 2131, pour le renouvellement ordinaire de l'enregistrement des hypothèques.\" Il est tenu un index des livres employés à la transcription de l'avis mentionné au présent article, de la même manière que l'index mentionné en l'article 2131.\" 2173.A défaut de tel renouvellement, les droits réels conservés par le premier enregistrement n'ont aucun effet à l'égard des autres créanciers, ou des acquéreurs subséquents dont les droits sont régulièrement enregistrés.\" 2176a.Chaque fois que le plan des lots d'une cité, d'une ville, d'un village, d'une paroisse, d'un canton ou d'une division quelconque de ces localités, faisant partie d'une division d'enregistrement, a été And ci nsidering the following provisions of articles 2168.2169, 2170, 2171, 2172, 2173 and 2176a of the Civil Codu of Lower Canada, to wit : \" 2168.When a cony of the plan and bonk of reference for the whole of a registration division has been deposited in the office for such division, and notion has been given by proclamation, in the manner mentioned in article 2100, the number given to a lot upon the plan and in the book of reference is the true description of such lot, and is sufficient as such in any document whatever ; and any part of such lot is sufficiency designated by stating that it is part of such lot and mentioning who is the owner thereof and the properties conterminous thereto ; and any piece of land composed of parts or more than one numbered lot is sufficiently designated by stating that it is so composed and mentioning what part of each nutnberod lot it contains.\" The description of an immoveable in the notice of application for confirmation of title, or in the notice of a aide by the sheriff or by forced licitation or of any sale having the effect of a sheriff's sale, or in the sheriff's deed, or in the judgment of confirmation, will not be deemed sufficient, unless it is made in conformity with the provisions of this article.\" As soon as such plan and book of reference have boon deposited and notice thereof has been given, notaries passing acts concerning immoveables indicated on such plan are bound to designate such immoveables by the number given to them upon such plan and in the book of reference, in the manner above prescribed ; in default of such designation, the registration does not affect the lot in question, unless there is filed a requisition or notice indicating the number on the plan and book of reference as being that of the lot intended to be affected by such registration.\" 2169.The deposit of the original plan and book of reference in any registration division is declared by a proclamation from the Governor in council, fixing at the same time the day on which the provisions of article 2168 shall come into force therein.\" 2170.The registrar, so soon as such deposit has been made, must prepare the index to immoveables mentioned in the second place in article 2161.\" 2171.From aud after the day appointed by such proclamation, the registrar must, from day to day, make up and continue the index to immoveables by entering under the number of each lot separately designated upon the plan and book of reference, a reference to each entry thereafter made in the other books and registers affecting such lota, so as to unable any person easily to ascurtain all the entries concerning it, made after that time.\" 2172.Within two years from the date fixed by the Lieutenant Governor's proclamation, bringing the provision! of article 2168 into force in any registration division, the registration of any real right upon any lot of land within such division must be renewed by moans of the registry at length, in the book kept for that purpose, of a notice describing the immoveable affected in the manner prescribed in article 2168, and conforming to th ether formalities prescribed in article 2131 for the ordinary renewal of the'registration of hypothecs.\" An index must be kept for the books used r the registration of the notice mentioned in this article, in the same manner as the index mentioned in article 2131.\" 2173.If such renewal bo not effected, the real rights preserved by the first registration have no effect against other creditors and subsequent purchasers whose cl ai, n s have been regularly registered.\" 2176a.Whenever the plan of the lots of any city, town, village, parish, township or any division whatsoever of such localities, forming part of any registration division, has been made in conformity 1()6 fait conformément ù la loi, le lieutenant-gouverneur en conseil peut faire déposer au bureau du* régistra-teur de la division d'enregistrement qu'il appartient, une copie correcte de M plan, ainsi qu'une copie eu livre de renvoi qui s'y rapporte.\" Le dépôt de ces plan et livre de renvoi, est annoncé par une proclamation du lieutenant-gouverneur un» conseil, fixant en mémo temps lu jour auquel les dispositions de l'articlu 2168 deviendront en vigueur dans cette division d'enregistrement, relativement à la localité dont lu plan a été ainsi déposé , ut à dater du l'époque tixée dans la proclamation, toutes les dispositions do eu code s'appliquent à ces plan et livre de renvoi, ainsi qu'aux propriétés qui y sont comprises, et aux contrais, hypothèques ou actes quelconques, concernant ou affectant ces propriétés, de la mûine manière que si le dépôt du plan de toute la division d'enregistrement eût été fait conformément à l'article 2106.Et attenhu que l'honorable Commissaire de la Colonisation et des Mines de Notre Province de Québec, a fait préparer, sous sa direction un plau et livre de renvoi officiels du cadastre du village de Kings ville, comté de Mégantic.Et attendu que les dits plan et livre de renvoi ont été dressés jusqu'à une date précise inarquée en iceux, lesquels sont signés par Notre dit Commissaire de la Colonisation et des Mines, et restent dans les archives du son bureau ; Et attendu qu'une copie des dits plan et livre de renvoi certifiée par le dit Commissaire de la Colonisation et des Mines a été déposée dans le bureau d'enregistrement de la division d'enregistrement du comté de MEGANTIC, et reste ouverte à l'inspection du public, pendant les heures de bureau, savoir : depuis neuf heures du matin jusqu'à trois heures de l'après-midi, chaque jour du la semaine, les dimanches ut lus fêtes exceptés ; Et attendu qu'à l'égard des dits plan et livre de renvoi, Notre dit Commissaire de la Colonisation et des Mines s'est en tout point conformé aux dispositions du dit article 5662 des Statuts refondus du la Ërovince de Québec, et à celles du Code Civil du as-Canada qui s'y rapportent ; ET ATTENDU que le lieutenant-gouverneur de Notre dite Province de Québec, de l'avis du Conseil Exécutif de la dite province, a fixé le SIXIEME jour du mois de FEV K1EK prochain, comme devant être lu jour à partir duquel les dispositions de l'article 2168 du t'ode Civil du Bas-Canada deviendront et seront un vigueur dans la dite division d'enro-gistrement du comté du MEGANTIC, relativement au village de KINGSVILLE, faisant partie de la dite division d'enregistrement ; and from the datu of the period fixed in such proclamation, all the provisions of this code apply to these plan and to such book of reference, and to all properties comprised in the said plan, and to all contracts, hypothecs or acts whatever concerning or affecting these properties, in the same manner as if the plan of the whole registration division had been deposited in conformity with article 2166.And whereas the Honorable Commissioner of Colonization and Mines of Our province of Quebec, has caused to be prepared, under his superintendence, a correct plan and book of reference of the cadastre of the village of Kingsville, county of Megautic.And whereas such plan and book of reference have been made up to some precise date marked upon the same, which bear also the signature of Our said Commissioner of Colonization and Mines,and remain of record in his office ; And whereas copy of such plan and book of reference certified by the said Commissioner of Colonization and Mines, has been deposited in the office of the registrar of the registration division of the county ot MEGANTIC, and there remains open to the inspection of the public, during office hours, that is to say : between the hours of nine in the forenoon and three in the afternoon, every day of the week, excepting Sundays and Holidays ; And whereas, so tar as regards such plan and book of reference, Our said Commissioner of Colonization and Mines has, in every respect, complied with the provisions of the said article 5662 of the Revised Statutes of the province of Quebec, and with those of the civil code of Lower Canada relating thereto ;
