Every persons engaged in such preparation or fitting out, or assisting therein, or employed in any capacity iu such expedition, .shall be guilty of un offence against this Act, and shall be punishable by line or imprisonment, or either of such punishments, at tho discretion of the court before which the offender is convicted ; and imprisonment, if awarded, may bo either with or without hard labor.(2.) And Wheheas such plan and book of reference have been made up to some precise dale, and those dates have been murked upon the same, which bear also the signature of Our said Commissioner of drown Lands ami remain of record in his ollice; And Wheheas copies of such plan and book of reference certified by the suid Commissioner Of Crown Lands have been deposited in the ollice of the Registrar for the said registration division of Montreal, and there remain open to the inspection of the public during ollice hours, that is to suy: between the hours of nine in the forenoon and fliree in the afternoon, every day of the week, excepting Sunduys und Holidays, as prescribed by the said Act; qu'une copie do chaque tel plan et Livre dé Renvoi, certifiée par le commissaire des terres de la couronne, sera déposée dans le bureau du régistratour dans le comté ou la division d'enregistrement où est située la place qu'ils indiquent, et y restera ouverte à l'inspection drt public pendant les heures de bureau ; qu'aussitôt que les plans et Livres de Renvoi, quant a aucun comté ou division d'enregistrement, auront été déposés comme ci-dsssus, dans le bureau du régistratour, le Gouverneur en conseil pourra le faire connaître par proclamation ; i 2.Le nom du propriétaire de chaque lot autant qu'il est possible de s'en assurer ; i 3.Toutes remarques nécessaires pour faire comprendre le plan.« Chaque lot de terre sur le plan y est indiqué par un numéro d'une seule série, qui est inscrit dans le livre de renvoi pour y désigner le môme lot.i 2168.AJirès que copie des plans et livres de renvoi a été déposée dans un bureau d'enregistrement pour toute sa circonscription, et qu'il a été donné avis par proclamation tel que mentionné en l'article 2109, le numéro donné à un lot sur le plan et dans le livre de renvoi est la vraie description de ce lot et suffit dans tout document quelconque ; And considering the following provisions of articles 2166, 2167.2168, 2169, 2170, 2171, 2172, 2173 and 217fi a of the Civil Code of Lower Canada, to wit ; i 2166.The Commissioner of Crown Lands furnishes each registry ollice with a copy ofa correct plan, made in conformity wiili the provisions of chapter 37 of the Consolidated Statutes for Lower Canada and the statute 27th and 28th Vict., ch.40, shewing distinctly all the lots of land of each city, town, village, parish, township, or part thereof, comprised within the division to which such ollice belongs.« 2167.Such plan must be accompanied by a copy ofa book of Reference in which are set forth : « I.A general description of each lot of land shewn upon the plan ; \u2022 2.The name of the owner of each lot, so far as it can be ascertained; i 3.All remarks necessary to the right understanding of the plan.« Each lot of land shewn upon the plan is designated thereon by a number, which is one of a single series and is entered in the book of reference to designate tho same lot.\u2022 2168.When a copy of the plans and books of référence for the whole ofa registration division has been deposited in the office for such division, and notice has bien gi- en by proclamation iu the manner mentioned in article 2109, the number given to a lot upon the plan ami in the book of reference is ibe true description of such loi, und is sufficient as such in any document whatever ; and any part of such lot is sufficiently designated by slating that it is part of such lot and mentioning who is the owner thereof and tho proportibs conterminous thereto; and uny piece of land compos-d of parts or more than one numbered lot is sufficiently designated by slating that it is so composed and mentioning whul part ofeuch numbered lot it conluius. 1209 \u2022 La description «l'un Immeuble dans l'avis d'une demande en ratilication de titre, ou dans l'avis d'une vente par le shérif, ou par licitatiou forcée, ou de toute autre vente ayant les effets du décret, ou dans telle vente ou jugement de ratification, ne sera censée sulll-sante que si elle e->t faite conformément aux prescriptions du présent acticle.i Aussitôt après que le dépôt «le tel plan et livre de renvoi a été fait et.qu'il en a été donné avis, les notaires sont tenus, en rédigeant .les actes concernant les immeubles indiqués sur tel plan,-do désigner ces immeubles par le numéro qui leur est donne sur le plan et dans le livre de renvoi, «le la manière prescrite ci-dessus ; à défaut de telle désignation l'enregistrement ne peut aU'ootcr le lot en «|uestion, à moins qu'il ne soit produit une réquisition ou avis indiquant le numéro sur le plan et livrede renvoi Comme étant celui du lot qu'on veut affecter par tel enregistrement.«S « 2109.Le dépôt des plans et livres de renvoi primitifs dans un«! circonscription d'enregistrement est annonce par proclamai ion du gouverneur en conseil, fixant eu même temps le jour auquel les dispositions de l'article '2108 y deviendront en force.« 2170.A compter de ce dépôt, le régislrutour doit préparer l'index mentionné en second lieu dans l'article 2101.i 2171.A compter «le l'époque fixée dans telle proclamation, le regislrateur doit faire l'index des immeubles et le continuer jour par jour en inscrivant sous chaque numéro de lot indiqué séparément au plan et au livre do renvoi, un renvoi à chaque entrée faite subséipieniment dans les autres livres et registres, affectant tel lot, de manière à mettre toute personne en état de constater facilement toutes les entrees fuites subséquemment concernant ce lot.i 2172.Dans les dix-huit mois qui suivent la proclamation du gouverneur pour la mise en force des dispositions de l'article 216$, dans une circonscription d'enregistrement, l'enregistrement de tout droit réel sur un lot de terre compris dans cette circonscription y doit être renouvelé au moyen de la transcription, dans le livre tenu à-cet effet, d'un avis désignant l'immeuble affecté en la manière prescrite en l'article 2108, en observant les autres formalités prescrites en l'article 2131 pour le renouvellement ordinaire de l'enregistrement des hypothèques.11! est tenu un index des livres employés à la transcription do l'avis mentionné au present article, «le la même manière que l'index mentionné en l'article 2131.«2173.A défuut de tel renouvellement, les droits réels conservés par le premier enregistrement n'ont aucun effet à l'égard des autres créanciers, ou des acquéreurs subséquents dont les droits sont régulièrement enregistrés, i «2176a.Chaque fois que le plan des lots de terre d'une cité, d'une ville, d'un village, d'une panasse, d'un canton, ou d'une division quelconque de ces localités, faisant partie d'une circonscription d'enregistrement, a été faite conformément aux dispositions du chapitre trente-sept «les Statuts Refondus pour le Ras-Canada, et de l'acte vingt-sept et vingt-huit Victoria, chapitre quarante; le Lieutenant-Gouverneur en conseil peut faire déposer au bureau du registre leur de la circonscription d'enregistrement qu'il appartient une copie correcte de »,e plan, ainsi qu'une copie du livre de renvoi qui s'y rapporte.« Le dépôt de tels plan et livre de renvoi, est annoncé par une proclamation du Lieutenant-Gouverneur en conseil, fixant en môme temps le jour auquel les dispositions do l'article deux mille cent soixante-el-huit deviendront en force dans cette circonscription d'enregistrement, relativement à la localité dont le plan des terres a été ainsi déposé ;
